Actual Production Clause Samples

The "Actual Production" clause defines how the real, measured output or results of a process, project, or asset are determined and recorded. In practice, this clause typically specifies the methods for measuring production, the timeframes for reporting, and the standards or instruments used to verify the actual quantities produced—such as the number of units manufactured, energy generated, or resources extracted. Its core function is to ensure that all parties have a clear, agreed-upon basis for assessing performance, calculating payments, or determining compliance, thereby reducing disputes and promoting transparency.
Actual Production. In respect of a fiscal year, the sum of (i) tons produced in the East and (ii) tons produced in the West divided by 5.
