Common use of Actions Simultaneous Clause in Contracts

Actions Simultaneous. Notwithstanding the order of the deliveries by the Parties set forth below, all deliveries shall be deemed to have occurred simultaneously and shall not be deemed to have been completed until each of the steps or conditions set forth or identified in this Section 3, entitled "Closing; Deliveries at Closing," has been completed or has been waived by the Party who is required or permitted to waive the same.
