Common use of Action of the Board Clause in Contracts

Action of the Board. In the event that the disability of the Superintendent is a Long Term or Permanent Disability, as defined in subparagraph 2 of the paragraph, the Board, may, in its discretion, and upon a re-determination of disability under subparagraph 3, terminate this Contract by providing the Superintendent with written notice of such termination.

Action of the Board. In the event that the disability of the Superintendent is a Long Term or Permanent Disability, as defined in subparagraph 2 (b) of the this paragraph, the Board, may, in its discretion, and upon a re-determination redetermination of disability Long Term or Permanent Disability under subparagraph 3(c), terminate this Contract by providing the Superintendent with written notice of such termination.

In the event that the disability of the Superintendent is a Long Term or Permanent Disability, as defined in subparagraph 2 (b) of the paragraphSection 4.2, the Board, may, in its discretion, and upon a re-determination of disability under subparagraph 3(c), terminate this Contract by providing the Superintendent with written notice of such termination.
