Common use of Action Determination Clause in Contracts

Action Determination. In deciding on an Action, the Requesting Party shall consider the following factors: a. The full nature of the Serious Threat, including the risk of population establishment, the risk of introduction to new areas (dispersal), the risk of impact on the Basin, and the overall risk of economic or environmental harm, or harm to human health; b. The feasibility of the Action’s effectiveness in addressing the Serious Threat, incorporating current knowledge about the Serious Threat, sufficient authority and time to act, public support, available resources, environmental soundness, cost effectiveness and overall likelihood of success; c. The Requesting Party’s internal capability for implementing an Action without Mutual Aid; d. The amount and duration of Mutual Aid to be requested from other Parties, if needed; and, e. The expected outcome from the Action.
