Common use of Acknowledgment of Trading Clause in Contracts

Acknowledgment of Trading. Subject to the agreements of the Manager set forth in Section 3(g), the Company consents to the Manager trading in the Common Shares for the Manager's own account and for the account of its clients at the same time as sales of the Shares occur pursuant to this Agreement or pursuant to a Terms Agreement, provided that the Manager will ensure appropriate and customary information barriers are in place with respect confidential information relating to the Company in order to ensure compliance with federal securities laws in connection with such sales.

Acknowledgment of Trading. Subject to the agreements of the Lead Manager set forth in Section 3(g), the Company consents to the Manager Managers trading in the Common Shares Stock for the each Manager's ’s own account and for the account of its clients at the same time as sales of the Shares occur pursuant to this Agreement or pursuant to a Terms Agreement, provided that the Manager Managers will ensure appropriate and customary information barriers are in place with respect confidential information relating to the Company in order to ensure compliance with federal securities laws in connection with such sales.
