Common use of Acceptance of Service of Process Clause in Contracts

Acceptance of Service of Process. In the event that any legal action is commenced against the City, service of process on the City shall be made by personal service upon the City Manager or in such other manner as may be provided by law. In the event that any legal action is commenced against the Participant, service of process on the Participant shall be made in such manner as may be provided by law and shall be effective whether served inside or outside of California.

Acceptance of Service of Process. In the event that any legal action is commenced by Developer against the City, service of process on the City shall be made by personal service upon the City Manager Clerk of City or in such other manner as may be provided by law. In the event that any legal action is commenced by City against the ParticipantDeveloper, service of process on the Participant Developer shall be made by personal service upon W-K Ventures, Inc., a California corporation, Developer’s registered agent for service of process in California, at 000 Xxxxxxx'x Xxxxxx Xxxxxxxxx, 0xx Xxxxx, Xxx Xxxxx, XX 00000 or in such other manner as may be provided by law and shall be effective whether served inside or outside of Californialaw.

In the event that any legal action is commenced by WD against the City, service of process on the City shall be made by personal service upon the City Manager Clerk, or in such other manner as may be provided by law. In the event that any legal action is commenced by either City against the ParticipantWD, service of process on the Participant WD shall be made in such manner as may be provided by law and shall be effective valid whether served inside made within or outside without the State of California.

In the event that any legal action is commenced by University against the City, service of process on the City shall be made by personal service upon City in such manner as may be provided by Law. In the event that any legal action is commenced by City Manager against University, service of process on University shall be made by personal service upon University at the address provided for notices or such other address as shall have been given to City by University under Section 12.2, or in such other manner as may be provided by law. In the event that any legal action is commenced against the ParticipantLaw, service of process on the Participant shall and will be valid whether made in such manner as may be provided by law and shall be effective whether served inside within or outside of the State of California.

In the event that If any legal action is commenced by the Developer against the CityCity or Agency, service of process on the City or Agency shall be made by personal service upon the City Manager or City Clerk of the City, or in such other manner as may be provided by law. In the event that If any legal action is commenced by the City or Agency against the ParticipantDeveloper, service of process on the Participant Developer shall be made by personal service upon both of the entities identified as joint venture members of the Developer, or in such other manner as may be provided by law and shall be effective law, whether served inside made within or outside without the State of California.

In the event that any legal action is commenced by the City against the ParticipantBorrower, service of process on the Participant Borrower shall be made by personal service upon the Borrower (or upon a general partner, managing member or officer of the Borrower)and shall be valid whether made within or without the State of California, or in such manner as may be provided by law and shall be effective whether served inside or outside of Californialaw.
