Acceptable Title. For purposes of this Agreement, “Acceptable Title” of the Property shall be a fee simple marketable record title vested in the Seller with full and complete authority and right to sell, subject only to the following exceptions (the “Permitted Exceptions”): (i) existing road rights-of-way located contiguous to the boundary lines of the property; (ii) real estate taxes for the year of the Closing and subsequent years; (iii) rules, regulations and future assessments, if any, by Southwest Florida Water Management District; (iv) any title conditions, defects or matters that are waived by the Buyer or that are deemed to be waived hereunder by the Buyer.
