Academic Use. Licensor retains a royalty-free, non-exclusive, non-sublicensable right to practice, and to permit affiliates, faculty, students, and staff of the Upstream Licensor to practice the Licensed Intellectual Property Rights solely for non-commercial research, teaching, educational, and scholarly publication purposes. Licensor shall provide Licensee with a copy of any proposed academic publication that discloses Confidential Information of Licensee at least thirty (30) days prior to submission or publication, solely for the purpose of allowing Licensee to identify its Confidential Information. Licensor shall remove any Confidential Information of Licensee identified in good faith prior to submission or publication. If Licensor reasonably determines that a patent application by or on behalf of the Upstream Licensor should be filed prior to submission or publication, Licensor may delay such submission or publication for a period of up to thirty (30) days from the date Licensee receives the proposed publication, or until such patent application is filed, whichever occurs first. For the avoidance of doubt: (a) nothing in this Section 2.7 shall be construed to grant Licensee any right to control, restrict, approve, or prevent academic research or publication, other than for identifying Confidential Information to be removed as provided in this Section 2.7; (b) Licensee shall have no right to file or prosecute patent applications arising from academic research or publications; (c) no additional rights to inventions, improvements, or future intellectual property, beyond those expressly granted elsewhere in this Agreement, are granted or implied by this Section 2.7; (d) any rights to new inventions or improvements shall arise, if at all, only pursuant to the Upstream License and a separate written agreement; and (e) no rights are granted under this Agreement, including under this Section 2.7, with respect to Gynecological Cancers or Breast Cancer, except as expressly set forth elsewhere in this Agreement.
Academic Use. If the software is designated or specially-priced as an "Academic" or "Education" version, it is licensed only for educational, non-commercial use by students, faculty, and staff of an educational institution.

Academic Use. 3.1. If Customer is an educational institution acquiring Purchased Services, in deviation to Section 2.1 the following additional terms and restrictions shall apply with respect to the Services: (a) For the purposes of Purchased Services made available for Academic Use, eligible “Users” shall be limited to Customer’s faculty members, staff, and students enrolled in a degree- or certificate-granting program; (b) Customer may use Purchased Services solely for academic use, and not for commercial, professional, or other for-profit purposes; (c) Purchased Services are not to be installed, accessed, used, or operated at or from facilities or locations that are operated for commercial, professional or for-profit purposes; and (d) access and use of Purchased Services is permitted solely from Customer-owned and -controlled computing devices and only for the following permitted academic use:
(i) If Purchased Services are acquired for “classroom use” or “teaching use”, solely for authorized classroom projects; and (ii) If Purchased Services are acquired for “academic research”, solely for Customer’s own non-commercial, academic research, where the results of such research are published or public domain. For avoidance of doubt, private or government restricted research projects require purchase of Purchased Services for commercial use. Any Purchased Services acquired by an educational institution are deemed to be acquired for Academic Use (and not commercial use), unless stated or indicated otherwise by Hexagon or its Affiliate in writing. Only qualified educational institutions (as determined by Hexagon or its Affiliate in its sole discretion), are eligible to acquire Purchased Services for Academic Use. Commercial organizations and other non-qualifying entities or persons are not eligible to acquire Purchased Services for Academic Use.
3.2. If Customer is an educational institute and entitled to technical support for Purchased Services acquired for Academic Use, the following additional terms and restrictions shall apply: Customer shall designate in writing a “Designated Contact” (“DC”). The DC shall be a knowledgeable full-time staff representative of Customer and serve as the focal point for administering and resolving all Customer requests for technical support. Where Customer is an academic institution pursuing research not connected to a for-profit entity and not for any commercial purposes (“Academic Customer”), W&B offers the W&B Assets free of charge to Academic Customer and its Authorized Users. An Academic Customer has the right to create 1 free team, invite colleagues and give each of them 1 free Authorized User seat. Academic Customers have no limit on the number of hours of tracking. Academic Customer will receive up to 100GB of storage with artifacts included (“Storage Cap”).
