Common use of Absence of Third-Party Filings Clause in Contracts

Absence of Third-Party Filings. Except for those filed in favor of Agent as contemplated by subsection 5.16A, no effective UCC financing statement, fixture filing or other instrument similar in effect covering all or any part of the Collateral is on file in any filing or recording office.

Absence of Third-Party Filings. Except for those such as may have been filed in favor of Administrative Agent as contemplated by subsection 5.16A, no effective UCC financing statement, fixture filing or other instrument similar in effect covering all or any part of the Collateral is on file in any filing or recording office.

Absence of Third-Party Filings. Except for those such as may have been filed in favor of Agent as contemplated by subsection 5.16AHBO or with respect to Permitted Encumbrances, no effective UCC financing statement, fixture filing or other instrument similar in effect covering all or any part of the Collateral is on file in any filing or recording office.

Except for those such as may have been filed in favor of the Administrative Agent as contemplated by subsection 5.16A, no effective UCC financing statement, fixture filing or other instrument similar in effect covering all or any part of the Collateral is on file in any filing or recording office.

Except for those such as may have been filed in favor of Administrative Agent as contemplated by subsection 5.16A5.16A or as permitted under subsection 7.2, no effective UCC financing statement, fixture filing or other instrument similar in effect covering all or any part of the Collateral is on file in any filing or recording office, except as may affect Collateral with a value not in excess of $5,000,000.

Except for those such as may have been filed in favor of Agent as contemplated by subsection 5.16ASection 9.2.1 and as set forth on Schedule 9.2.3 annexed hereto, (i) no effective UCC financing statement, fixture filing or other instrument similar in effect covering all or any part of the Collateral is on file in any filing or recording office, and (ii) no effective filing covering all or any part of the Intellectual Property Collateral is on file in the PTO.
