Common use of Ability to Work Clause in Contracts

Ability to Work. Unit employees shall possess and maintain sufficient good health (physical and mental) to satisfactorily perform the essential functions of their assigned position. In cases where the Administrator believes a unit employee’s physical or mental condition has caused inadequate performance in the classroom, the unit employee may be requested by the Superintendent, or designated representative, to submit to a physical or psychiatric examination. Expenses for such examination shall be paid by the Board. Failure to acknowledge the request may be adequate cause for discipline.
