5Using Agency, Using Agency’s Representative Sample Clauses

5Using Agency, Using Agency’s Representative. The Using Agency is the entity that will occupy or use the Project upon Material Completion and is an express third-party beneficiary of this Contract. The Using Agency may designate one or more representatives to advise Owner. Neither the Using Agency nor any representative of Using Agency shall have any authority to act on behalf of Owner. CM/GC may not act or rely upon any directive, interpretation, decision, act, or omission of Using Agency or the Using Agency’s Representative.
