2005 Indenture. The Borrower hereby informs the Lenders that the Debt evidenced by the Loans and L/C Obligations has been incurred pursuant to Section 4.09(b)(i) of the 2005 Indenture. As a result thereof, the Borrower is permitted to secure such Debt pursuant to clause (i) of the definition of “Permitted Liens” as set forth in Section 1.01 of the 2005 Indenture, subject to the terms of Section 4.09(b)(i) of the 2005 Indenture.
