Application. 2.1 These general conditions are applicable to all bids, contracts and orders including bids for functional and professional services (excluding professional services related to the building and construction industry), sales, hiring, letting and the granting or acquiring of rights, but excluding immovable property, unless otherwise indicated in the bidding documents. 2.2 Where applicable, special conditions of contract are also laid down to cover specific goods, services or works. 2.3 Where such special conditions of contract are in conflict with these general conditions, the special conditions must apply. Application. 1.1 The Purchaser must please read the following provisions, terms and conditions ("hereinafter referred to as Terms") carefully as these Terms shall apply to the sale by the Company of all goods and materials ("Goods"), and the rendering by the Company of all services ("Services"), to the Purchaser to the exclusion of all other terms and conditions, including those of the Purchaser. “Days” shall be construed as calendar days. 1.2 The Purchaser must not conclude this agreement if the Purchaser: 1.2.1 Does not agree or does not understand the meaning of any of these Terms; 1.2.2 Any of these Terms are untrue; and / or 1.2.3 Has not been given enough time to read and comprehend the meaning of the terms contained in this agreement, particularly those in bold font. 2
