Power of taking decision about extradition. Upon receiving the extradition request from the Minister in charge of Foreign Affairs, after consultation with the National Public Prosecution Authority or Military Prosecution Department and after checking whether the conditions provided under this Law or extradition treaty are met, the Minister in charge of Justice shall take a decision to surrender the requested person. However, if there is an extradition treaty which provides that the decision of the extradition is taken by a judge, the Minister in charge of Justice shall immediately forward the extradition request to the National Public Prosecution Authority or Military Prosecution Department in order for them to ask the relevant authority to determine whether the requested extradition can be granted. In case of a need to take a provisional or confiscation measure, the request shall be made through the relevant court upon request by the National Public Prosecution Authority or Military Prosecution Department.entente mutuelle entre les deux Etats, l’Etat requérant indiquant au Rwanda dans un traité spécial qu’il respectera également une demande similaire faite par le Rwanda. Article 11: Pouvoir de prendre une décision sur l’extradition Après avoir reçu la demande d'extradition de la part du Ministre ayant les affaires étrangères dans ses attributions et après concertation avec l’Organe National de Poursuite Judiciaire ou avec l’Auditorat Militaire et après avoir vérifié si les conditions prévues par la présente loi ou les traités d’extradition sont remplis, le Ministre ayant la justice dans ses attributions prend la décision de remettre la personne recherchée. Toutefois, dans le cas d’un traité d’extradition qui prévoit que la décision sur l’extradition est laissée à la discrétion d’un juge, le Ministre ayant la justice dans ses attributions transmet immédiatement la demande à l’Organe National de Poursuite Judiciaire ou à l’Auditorat Militaire pour que celui-ci demande à l’autorité habilitée de déterminer si l’extradition demandée peut être accordée. En cas de nécessité de mesure conservatoire ou de confiscation, la demande se fait par le biais de la juridiction compétente sur demande de l’Organe National de Poursuite Judiciaire ou l’Auditorat Militaire.
