Grounds for rejection of extradition. The Minister in charge of justice shall not grant the extradition in any of the following circumstances: 1° if Rwanda has evidence to indicate that the request for extradition was made for the purpose of prosecuting or punishing the requested person on the basis of that person’s race/ethnicity, religion, nationality, origin, political opinions, sex or status or if that the person’s position may be prejudiced due to one of these reasons;1º les traités existant entre le Rwanda et les Etats requérants; 2º la période et le lieu de la commission de l’infraction; 3º l’ordre d’arrivée des demandes; 4º la nationalité de la personne recherchée et celle de la victime; 5º si l’extradition est demandée aux fins des poursuites ou de purger une peine; 6º la gravité de l’infraction.
