Concurrent requests. When several States request extradition either for the same offence or for different offences, the Minister in charge of justice shall determine for which State the extradition to be granted. The following factors shall be considered when determining for which State the extradition to be granted:la personne recherchée a été lancé ou si une condamnation a été prononcée pour l’une des infractions donnant lieu à extradition. Lorsque le Ministre ayant la justice dans ses attributions constate que ces conditions sont remplies, il donne instruction par écrit au Procureur Général ou à l’Auditeur Général Militaire de procéder à la détention provisoire de cette personne recherchée. Article 14: Interdiction de l’utilisation des éléments de preuve contraires à ceux de la demande L’utilisation dans des enquêtes ou des procédures des éléments de preuve non conformes à ceux prévus à la demande d’un autre pays est prohibée. Une telle utilisation peut entrainer la nullité desdites enquêtes et procédures, sauf consentement préalable de l’Etat requérant. Article 15: Demandes concurrentes Lorsque plusieurs Etats demandent l’extradition soit pour une même infraction, soit pour des infractions différentes, le Ministère ayant la justice dans ses attributions détermine l’Etat pour lequel l’extradition sera accordée.
