CODE OF CONDUCT TOWARDS CONSUMERS
1. GENERAL
1.1 Scope
Latvijas Tiešās tirdzniecības asociācijas rīcības kodeksu attiecībā uz patērētājiem (turpmāk tekstā
— „kodekss”) ir pieņēmusi Latvijas Tiešās tirdzniecības asociācija, kas ir Seldia — Eiropas Tiešās tirdzniecības asociācijas — biedre, saskaņā ar Eiropas tiešās tirdzniecības rīcības kodeksu attiecībā uz patērētājiem. Kodekss attiecas uz attiecībām starp tiešās tirdzniecības uzņēmumiem un tiešajiem pārdevējiem no vienas puses un patērētājiem no otras puses. Kodeksa mērķis ir panākt patērētāju gandarījumu un aizsardzību, veicināt godīgu konkurenci brīvas uzņēmējdarbības ietvaros, uzlabot tiešās tirdzniecības publisko tēlu, kuras galvenais mērķis ir pārdot kvalitatīvus produktus patērētājiem ar godīgiem noteikumiem un nosacījumiem.
1.2. Terminu skaidrojums
The Latvian Direct Selling Association’s Code of Conduct towards Consumers (hereinafter referred to as the “Code”) is adopted by the Latvian Direct Selling Association, which is a member of Seldia – the European Direct Selling Association, following the European Direct Selling Code of Conduct towards Consumers. The Code concerns the relations between direct selling companies and direct sellers on the one hand and consumers on the other hand. The Code is aimed at achieving the satisfaction and protection of consumers, the promotion of fair competition in the framework of free enterprise, and the enhancement of the public image of direct selling, which is to sell quality products on fair terms and conditions to consumers.
1.2 Glossary of terms
Šajā kodeksā:
1) tiešā tirdzniecība nozīmē jebkādu tirdzniecības metodi, kas pamatojas uz to, ka pārdevējs, turpmāk tekstā — „tiešais pārdevējs”, patērētājam izskaidro vai demonstrē produktu ārpus uzņēmējdarbības telpām;
2) patērētājs ir jebkura fiziska persona, kura iegādājas produktus mērķiem, kas nav saistīti ar viņa īstenotu tirdzniecību, uzņēmējdarbību vai profesiju;
3) LTTA — Latvijas Tiešās tirdzniecības asociācija ir tiešās tirdzniecības uzņēmumu valsts asociācija, kas Latvijā pārstāv tiešās tirdzniecības uzņēmumus un kas ir Seldia — Eiropas Tiešās tirdzniecības asociācijas — biedre;
4) uzņēmums ir jebkāda uzņēmējdarbības vienība, kas tirgo produktus, kas saistīti ar prečzīmi, pakalpojumu zīmi vai identificējošu simbolu, izmantojot izplatīšanas sistēmu, kas balstās uz tiešo tirdzniecību, un kas ir LTTA biedrs;
5) izplatīšanas sistēma ir jebkāda organizācija un metode, kas izstrādātas produktu tirdzniecībai;
6) tiešais pārdevējs ir jebkura fiziska vai juridiska
For the purpose s of this Code:
(1) Direct selling means any selling method which is based on the explanation or demonstration of products to a consumer by a salesperson, hereinafter called direct seller, away from business premises.
(2) Consumer means any natural person who buys products for purposes which can be regarded as outside his trade, business or profession.
(3) LDSA – Latvian Direct Selling Association is national association of direct selling companies which represents the direct selling industry in Latvia and which is a member of Seldia – the European Direct Selling Association.
(4) Company means any business entity which markets products associated with its trademark or service mark or identifying symbol through a distribution system based on direct selling and which is a member of the LDSA.
(5) Distribution system means any organization and method designed for the marketing of products.
(6) Direct seller means any natural or legal person

Tiešajiem pārdevējiem var būt tiesības piesaistīt citas personas un piedāvāt tām kļūt par tiešajiem pārdevējiem. Tiešais pārdevējs var būt neatkarīgs tirdzniecības aģents, neatkarīgs darbuzņēmējs, neatkarīgs tirgotājs vai izplatītājs, nodarbināts vai pašnodarbināts pārstāvis vai cits līdzīgs uzņēmuma produktu izplatītājs;
7) produkts ir jebkāda materiāla vai nemateriāla prece vai pakalpojums;
8) pārdošana ir saziņa ar potenciālajiem patērētājiem, produktu piegāde vai demonstrēšana, pasūtījumu pieņemšana, produktu piegāde un maksājuma saņemšana;
9) pārdošanas viesības ir tiešā tirdzniecība patērētāju grupai, kuru saimnieks ir uzaicinājis šādam nolūkam;
10) pasūtījuma veidlapa ir iespiests vai rakstisks dokuments, kurā ir norādītas ziņas par patērētāja pasūtījumu un kas tiek izsniegts patērētājam kā kvīts par notikušo pirkšanas un pārdošanas darījumu. Interneta tirdzniecības gadījumā tā ir pastāvīgā informācijas nesējā saglabāta veidlapa, kurā ir norādīti visi attiecīgā piedāvājuma un pirkuma nosacījumi;
11) darbinieku piesaiste ir darbība, ko veic ar mērķi piedāvāt personai iespēju kļūt par tiešo pārdevēju;
12) kodeksa administrators ir neatkarīga persona vai iestāde, kuru ir iecēlusi LTTA, lai tā uzraudzītu, kā uzņēmumi ievēro LTTA kodeksu, un lai izskatītu sūdzības saskaņā ar kodeksu.
1.3. Uzņēmumi
who is member of the distribution system of a direct selling company and who sells, facilitates or assists in the sale of products of that company away from business premises.
Direct sellers’ may be entitled to recruit other persons to become Direct Sellers. A Direct Seller may be an independent commercial agent, independent contractor, independent dealer or distributor, employed or self- employed representative, or any other similar sales representative of a Company.
(7) Product means any goods, tangible or intangible, or service.
(8) Selling means communication with potential customers, delivery of products or demonstration, taking orders, delivery of products and receipt of the payment.
(9)Party selling means direct selling to a group of consumers invited by a host to that end.
(10)Order form means a printed or written document confirming details of a Consumer order and providing a sales receipt to the Consumer. In the case of Internet purchases, a form containing all terms of the offer and purchase provided in durable medium.
(11) Recruiting means activity conducted for the purpose of offering a person the opportunity to become a direct seller.
(12) Code administrator means an independent person or body appointed by the LDSA to monitor member companies’ observance of the LDSA’s Code and to resolve complaints under the Code.
1.3. Companies
Katrai LTTA dalības organizācijai ir jāņem vērā kodekss, lai tās tiktu uzņemtas un varētu turpināt dalību LTTA. Katrai LTTA dalības organizācijai ir prasīts publiski popularizēt dalību LTTA un šo kodeksu.
1.4. Tiešie pārdevēji
Every LDSA member company pledges to abide by the Code as a condition of admission and continuing membership in the LDSA. Every LDSA member company shall be required to promote to the public its LDSA affiliation and this Code.
1.4 Direct Sellers
Tiešajiem pārdevējiem kodekss nav tieši saistošs, bet, lai tie varētu piedalīties uzņēmuma izplatīšanas sistēmās, tiem ir jāņem vērā kodekss vai rīcības noteikumi, kas atbilst tā standartiem.
Direct sellers are not bound directly by the Code, but shall be required by their companies to adhere to it or to rules of conduct meeting its standard as a condition of membership in the companies’

1.5 Self-regulation
Kodekss ir tiešās tirdzniecības nozares pašpārvaldes pasākums. Tas nav likums, un tajā noteiktās saistības var pieprasīt tādu ētiskās rīcības līmeni, kas pārsniedz likumā noteiktās prasības. Tā neievērošana nerada nekāda veida civiltiesisko atbildību. Pārtraucot dalību LTTA, uzņēmumam vairs nav saistošs kodekss, kā noteikumi paliek piemērojami notikumiem vai darījumiem, kas radušies laikā, kad uzņēmums bija LTTA biedrs.
1.6. Tiesību akti
The Code is a measure of self-regulation by the direct selling industry. It is not a law, and its obligations may require a level of ethical behaviour which exceeds existing legal requirements. Non- observance does not create any civil law responsibility. With termination of its membership in the LDSA, a company is no longer bound by the Code, the provisions of which remain applicable to events or transactions occurring during the time a company was a member of the LDSA.
1.6 Law
Uzņēmumiem un tiešajiem pārdevējiem ir jāņem vērā tiesību aktu prasības, un tādēļ kodeksā nav pārfrāzētas visas tiesību aktos noteiktās saistības.
1.7. Standarti
Companies and direct sellers are presumed to comply with the requirements of law and therefore the Code does not restate all legal obligations.
1.7 Standards
Kodeksā ir iekļauti ētiskās rīcības standarti tiešās tirdzniecības uzņēmumiem un tiešajiem pārdevējiem. Kodeksu ir ieteicams izmantot kā nozares standartu liecību.
1.8. Eksteritoriāla piemērojamība
The Code contains standards of ethical behaviour for direct selling companies and direct sellers. It is recommended that the Code be used as evidence of industry standards.
1.8 Extraterritorial effect
LTTA kā nosacījumu iestājai un nepārtrauktai dalībai LTTA katram biedram pieprasīs saistībā ar tiešās tirdzniecības darbībām, kas tiek veiktas ārpus attiecīgā uzņēmuma piederības valsts, ņemt vērā Eiropas tiešās tirdzniecības rīcības kodeksus, ja vien uz minētajām darbībām neattiecas rīcības kodeksi, ko ir pieņēmusi citas valsts TTA, kurā attiecīgais uzņēmums ir uzņemts un kas arī ir Seldia biedre.
Ja saistībā ar uzņēmuma rīcību tiek iesniegta sūdzība par kodeksa pārkāpumu un tas tiek darīts valstī, kurā attiecīgais uzņēmums nav TTA biedrs, minētajam uzņēmumam ir jāpieņem, ka attiecīgās sūdzības izskatīšana ir šā uzņēmuma piederības valsts kodeksa administratora jurisdikcijā (vai, ja attiecīgais uzņēmums nav savas piederības valsts TTA biedrs, tādas valsts kodeksa administratora jurisdikcijā, kurā attiecīgais uzņēmums ir TTA biedrs), un jāsedz pamatotas izmaksas, kas piederības valsts kodeksa administratoram ir radušās saistībā ar sūdzības izskatīšanu. Turklāt piederības valsts kodeksa administrators var saskaņot savu rīcību ar sūdzības iesniedzēja piederības valsts kodeksa administratoru (ja tāds ir) un, izvērtējot sūdzību par iespējamo kodeksa pārkāpumu, prioritārā secībā piemērot i) tās valsts ētikas kodeksa normas, kurā ir iesniegta sūdzība,
LDSA pledges that it will require each member as a condition of admission and continuing membership in the LDSA to comply with the European Codes of Conduct for Direct Selling with regard to direct selling activities outside its home country, unless those activities are under the jurisdiction of Codes of Conduct of another country’s Seldia - affiliated DSA to which the member also belongs.
Should a company be subject of a Code Complaint in a country in which it is not a member, the company must accept jurisdiction of the Code Administrator in its home country (or if the company is not a member in its home country, any country in which it is a DSA member), and shall bear reasonable costs incurred by the home country Code Administrator associated with resolution of the Complaint. Moreover, the Code Administrator of the home country may coordinate with the Code Administrator (if one exists) of the complainant’s country and, in evaluating the alleged Code Complaint, apply, in order of priority, (i) the standards of the Code of Ethics in the country in which the complaint is filed, or, (ii) the standards of the Code of Ethics in the subject company’s home country, or (iii) at a minimum, the standards set forth in the European Code of Ethics.

2.1. Prohibited Practices
Tiešie pārdevēji un uzņēmumi nedrīkst izmantot maldinošas, agresīvas vai negodīgas tirdzniecības metodes.
2.2. Identificēšana
Direct sellers and companies shall not use misleading, aggressive or unfair sales practices.
2.2. Identification
Tirdzniecības prezentācijas sākumā tiešajiem pārdevējiem potenciālajiem patērētājiem ir bez iepriekšēja uzaicinājuma skaidri un godīgi jānosauc savs vārds un pārstāvētā uzņēmuma nosaukums, kā arī jāatklāj piedāvāto produktu būtība un piedāvājuma mērķi.
2.3. Izskaidrošana un demonstrēšana
At the initiation of a sales presentation, Direct Sellers shall, without request, truthfully and clearly identify themselves; the identity of their Company; the nature of their Products; and the purpose of their solicitation to the prospective Consumer.
2.3. Explanation and Demonstration
Tiešajiem pārdevējiem ir jāsniedz patērētājiem
precīzi un pilnīgi paskaidrojumi un demonstrējumi attiecībā uz konkrētā produkta īpašībām, cenu un, ja nepieciešams, kredīta noteikumiem, samaksas noteikumiem, anulēšanas tiesībām, atpakaļatdošanas politiku, garantijas noteikumiem, pēcpārdošanas pakalpojumiem un piegādes termiņu. Tiešajiem pārdevējiem ir
jāsniedz precīzas un saprotamas atbildes uz visiem patērētāju uzdotajiem jautājumiem. Ja tiek
izteikti jebkādi apgalvojumi par produkta
efektivitāti, tiešie pārdevēji gan mutvārdos, gan
rakstveidā drīkst izteikt tikai tādus apgalvojumus, kādus tiem ir atļāvis izteikt pārstāvētais
uzņēmums.
Patērētājam informācija ir jāsniedz skaidri un saprotami, ņemot vērā labticības principus, kas ir jāievēro tirdzniecības darījumos, un principus, kas attiecas uz tādu personu aizsardzību, kuras
saskaņā ar valsts tiesību aktiem nav spējīgas sniegt savu piekrišanu, piemēram, uz
nepilngadīgu personu aizsardzību.
2.4. Pasūtījuma veidlapa
Direct Sellers shall offer Consumers accurate and complete Product explanations and demonstrations regarding product characteristics, price and, if applicable, credit terms; terms of payment; the right of withdrawal; return policies; terms of guarantee; after-sales service; and delivery dates. Direct Sellers shall give accurate and understandable answers to all questions from Consumers. To the extent claims are made with respect to product efficacy, Direct Sellers shall make only those verbal or written product claims that are authorized by the Company.
The information given to the consumer shall be provided in a clear and comprehensible manner with due regard to the principles of good faith in commercial transactions and the principles governing the protection of those who are unable, pursuant to national legislation, to give their consent, such as minors.
2.4. Order Form
Pārdošanas laikā vai pirms produkta pārdošanas patērētājam ir jāizsniedz vai citādi jādara pieejama rakstveida pasūtījuma veidlapa. Ja tirdzniecība notiek pa pastu, pa tālruni, internetā vai citā veidā, kas izslēdz tiešu saskari starp pircēju un pārdevēju, pasūtījuma veidlapai ir jābūt izsniegtai jau iepriekš vai tā ir jāpievieno sākotnējam piedāvājumam, vai jādara pieejama internetā izdrukājamā vai lejupielādējamā formā. Pasūtījuma veidlapā ir
A written Order Form shall be delivered or made available to the Consumer at or prior to the time of the initial sale. In the case of a sale made via mail, telephone, the Internet, or similar non face-to-face means, a copy of the Order Form shall have been previously provided, or shall be included in the initial order, or shall be provided in printable or downloadable form via the Internet. The order form shall identify the company and the direct seller and

2.5. Anulēšanas tiesības un preču atpakaļatdošana

2.5. Right of withdrawal and Return of Goods
Uzņēmumiem un tiešajiem pārdevējiem ir jānodrošina, lai jebkurā pasūtījuma veidlapā neatkarīgi no tā, vai tā ir likumā noteikta prasība, vai nē, būtu norādījums par anulēšanas tiesībām laikposmā, kas nav īsāks par 14 dienām, ieskaitot tiesības un nosacījumus atgūt jebkādus maksājumus vai iemainītās preces; vai jāinformē patērētājs par anulēšanas tiesību neesamību. Uzņēmumiem un tiešajiem pārdevējiem, kas piedāvā beznosacījumu atpakaļatdošanas tiesības, tas jānorāda rakstveidā.
2.6. Garantija un pēcpārdošanas pakalpojumi
Companies and direct sellers shall make sure that any order form contains, whether it is a legal requirement or not, a right of withdrawal during a period that is not less than 14 days, including the right and conditions to obtain reimbursement of any payment or goods traded in; or informs the consumer of an absence of right of withdrawal. Companies and direct sellers offering an unconditional right of return shall provide it in writing.
2.6. Guarantee and After-Sales Service
Pasūtījuma veidlapā vai tai pievienotajos materiālos, vai kopā ar produktu pircējam ir jāsniedz skaidra informācija par garantijas vai galvojuma noteikumiem, papildu informācija par pēcpārdošanas pakalpojumiem un to ierobežojumiem, jānorāda garantijas sniedzēja vārds un adrese, garantijas ilgums un novēršanas pasākumi, kas pieejami pircējam.
2.7. Papildu materiāli
Terms of a guarantee or a warranty, details and limitation of after-sales service, the name and address of the guarantor, the duration of the guarantee and the remedial action open to the purchaser shall be clearly set out in the order form or other accompanying literature or provided with the product.
2.7. Literature
Papildu materiālos, reklāmās vai vēstulēs nedrīkst būt iekļauts nepatiess vai maldinošs produkta apraksts, apgalvojumi par to vai ilustrācijas. Tajos ir jābūt minētam uzņēmuma nosaukumam, adresei vai tālruņa numuram, un tajos var būt norādīts arī tiešā pārdevēja tālruņa numurs. Tiem ir jāatbilst šā kodeksa prasībām un noteikumiem, kas attiecas uz tirgdarbību, kuras mērķauditorija ir bērni un nepilngadīgas personas, jo īpaši Negodīgas komercprakses direktīvas un Audiovizuālo mediju pakalpojumu direktīvas noteikumiem.
2.8. Atsauksmes
Promotional literature, advertisements or mailings shall not contain any product description, claims or illustrations which are deceptive or misleading. It shall contain the name and address or telephone number of the company and may include the telephone number of the direct seller. It shall also be compliant with the present Code and the rules regarding marketing towards children and minors, in particular those of the Unfair Commercial Practices Directive and the Audiovisual Media Services Directive.
2.8. Testimonials
Uzņēmumi un tiešie pārdevēji nedrīkst minēt nekādas atsauksmes vai apstiprinājumus, kas nav atļauti, nav patiesi, ir novecojuši vai citādi vairs nav piemērojami, nav saistīti ar viņu piedāvājumu vai tiek izmantoti tā, ka tie varētu maldināt patērētāju.
2.9. Salīdzināšana un nomelnošana
Companies and direct sellers shall not refer to any testimonial or endorsement which is not authorized, not true, obsolete or otherwise no longer applicable, not related to their offer or used in any way likely to mislead the consumer.
2.9. Comparison and Denigration
Uzņēmumiem un tiešajiem pārdevējiem ir jāizvairās no tādu salīdzinājumu izmantošanas,

kas varētu būt maldinoši vai neatbilst godīgas konkurences principiem. Salīdzināšanu drīkst veikt vienīgi saskaņā ar noteikumiem par salīdzinošo reklāmu, kas izklāstīti Direktīvā 2006/114/EK par maldinošu un salīdzinošu reklāmu. Uzņēmumi un tiešie pārdevēji ne tieši, ne pastarpināti nedrīkst nomelnot nevienu uzņēmumu vai produktu. Uzņēmumi un tiešie pārdevēji nedrīkst negodīgi izmantot priekšrocības, ko sniedz cita uzņēmuma vai produkta tirdzniecības nosaukuma un simbola prestižs.
2.10. Privātuma ievērošana

Comparisons shall only be made in accordance with the provisions on comparative advertising set out in Directive 2006/114/EC concerning misleading and comparative advertising. Companies and direct sellers shall not denigrate any firm or product directly or by implication. Companies and direct sellers shall not take unfair advantage of the goodwill attached to the trade name and symbol of another firm or product.
2.10. Respect of Privacy
Personiska saziņa, saziņa pa tālruni vai elektroniski notiek saprātīgā veidā un laikā, lai tā nebūtu uzbāzīga. Tiešajam pārdevējam ir jāpārtrauc demonstrēšana vai tirdzniecības prezentācija, ja to pieprasa patērētājs. Uzņēmumiem un tiešajiem pārdevējiem ir atbilstoši jārīkojas, lai nodrošinātu visas esošo vai iespējamo patērētāju sniegtās privātās informācijas aizsardzību.
2.11. Godīgums
Personal, telephone or electronic contact shall be made in a reasonable manner and during reasonable hours to avoid intrusiveness. A direct seller shall discontinue a demonstration or sales presentation upon the request of the consumer. Companies and Direct Sellers shall take appropriate steps to ensure the protection of all private information provided by actual or prospective customers.
2.11. Fairness
Tiešie pārdevēji nedrīkst ļaunprātīgi izmantot individuālu patērētāju uzticību, tiem ir jāciena patērētāju komerciālās pieredzes trūkums, un tie nedrīkst negodīgi izmantot patērētāju vecumu, slimību, garīgu vai fizisku invaliditāti, lētticību, izpratnes trūkumu vai valodas zināšanu trūkumu.
2.12. Piesaistīšana tirdzniecībai
Direct sellers shall not abuse the trust of individual consumers, shall respect the lack of commercial experience of consumers and shall not exploit a consumer’s age, illness, mental or physical infirmity, credulity, lack of understanding or lack of language knowledge.
2.12. Referral Selling
Uzņēmumi un tiešie pārdevēji nedrīkst mudināt patērētājus iegādāties produktus, pamatojoties uz apgalvojumu, ka patērētājs var samazināt vai pat segt pirkuma cenu, piesaistot citus patērētājus pārdevējam un iesakot veikt līdzīgus pirkumus, ja šādi samazinājumi vai atlīdzināšana ir atkarīga no nedrošiem notikumiem nākotnē.
2.13. Izpilde
Companies and direct sellers shall not induce a consumer to purchase products based upon the representation that a consumer can reduce or recover the purchase price by referring other consumers to the sellers for similar purchases, if such reductions or recovery are contingent upon some unsure future event.
2.13. Performance
Jebkurš pasūtījums ir jāizpilda pēc iespējas ātrāk un ne vēlāk kā 30 dienu laikā pēc līguma noslēgšanas, ja vien puses nav vienojušās citādi.
Patērētājiem ir jābūt informētiem, ja uzņēmumi vai tiešie pārdevēji nav spējīgi izpildīt saistības tādēļ, ka pasūtītie produkti nav pieejami. Šādā gadījumā patērētāji var saņemt jebkuru samaksāto summu atmaksu, cik ātri vien iespējams, un 30 dienu laikā no brīža, kad uzņēmums ir saņēmis paziņojumu par anulēšanu.
Any order shall be executed as quickly as possible and in any case within 30 days from the conclusion of the contract, unless the parties have agreed otherwise.
Consumers shall be informed if companies or direct sellers are unable to perform their side of the contract on the grounds that the products ordered are unavailable. In that case, consumers may obtain a refund of any sums they have paid as soon as possible and in any case within 30 days from the day on which the company receives the communication of the withdrawal.

Primārā atbildība par kodeksa ievērošanu ir katram atsevišķam uzņēmumam. Ja kodekss tiek pārkāpts, uzņēmums dara visu iespējamo, lai gandarītu sūdzības iesniedzēju.
Katram dalības uzņēmumam un topošam dalības uzņēmumam ir jāieceļ LTTA kodeksa atbildīgā amatpersona. Kodeksa atbildīgā amatpersona ir atbildīga par to, lai atvieglotu uzņēmumam kodeksa ņemšanu vērā un atbildētu uz LTTA kodeksa administratora pieprasījumiem. Tāpat viņš vai viņa ir galvenā kontaktpersona uzņēmumā, kas ziņo par LTTA Ētikas kodeksa principiem neatkarīgiem pārdevējiem, uzņēmuma darbiniekiem, patērētājiem un sabiedrībai.
3.2. LTTA atbildība
The primary responsibility for the observance of the Code shall rest with each company. In case of any breach of the Code, companies shall make every reasonable effort to satisfy the complainant. Each member company and pending member company is required to designate a LDSA Code Responsibility Officer. The Code Responsibility Officer is responsible for facilitating compliance with the Code by their company and responding to inquiries by the LDSA Code Administrator. He or she will also serve as the primary contact at the company for communicating the principles of the LDSA Code of Ethics to their independent salespeople, company employees, customers and the general public.
3.2. LDSA Responsibility

LDSA shall provide a person responsible for complaint handling. LDSA shall make every reasonable effort to ensure that complaints are settled.
3.3. Code Administrator
LTTA par kodeksa administratoru ieceļ neatkarīgu personu vai iestādi. Kodeksa administrators, veicot atbilstīgas darbības, uzrauga to, kā uzņēmumi ievēro kodeksu. Kodeksa administrators risina jebkādas neatrisinātas patērētāju sūdzības, kas balstās uz kodeksa pārkāpumiem, un iesniedz ikgadēju ziņojumu par kodeksa darbību.
3.4. Darbības
LDSA shall appoint an independent person or body as Code Administrator. The Code Administrator shall monitor companies’ observance of the Code by appropriate actions. The Code Administrator shall settle any unresolved complaint of consumers based on breaches of the Code and shall furnish an annual report on the operation of the Code.
3.4. Actions
Darbības, par kādām var lemt uzņēmumi, LTTA vai kodeksa administrators, var iekļaut pasūtījumu atcelšanu, iegādāto produktu atpakaļatdošanu, maksājuma atlīdzināšanu vai citas atbilstīgas darbības, tostarp brīdinājumus tiešajiem pārdevējiem, tiešo pārdevēju līgumu vai cita veida attiecību ar uzņēmumu izbeigšanu, brīdinājumus uzņēmumiem, uzņēmumu izslēgšanu no LTTA biedru skaita, un šādu darbību un sankciju publicēšanu.
3.5. Sūdzību izskatīšana
Actions to be decided on by companies, LDSA or Code Administrator may include cancellation of orders, return of goods purchased, refund of payment or other appropriate actions, including warnings to direct sellers, cancellation or termination of direct sellers’ contracts or other relationships with the company, warnings to companies, exclusion of companies from LDSA membership, and the publication of such actions and sanctions.
3.5. Complaint Handling
Uzņēmumi, LTTA un kodeksa administrators izstrādā sūdzību izskatīšanas kārtību un nodrošina, lai īsā laikposmā tiktu apstiprināta katras sūdzības saņemšana un saprātīgā laikposmā tiktu pieņemti lēmumi. Patērētāja sūdzību izskatīšana patērētājam ir bez maksas.
Companies, LDSA and Code Administrator shall establish complaint-handling procedures and ensure that receipt of any complaint is confirmed within a short time and decisions are made within a reasonable time. Handling of consumer complaints shall be free of charge to the consumer.

LTTA publicē kodeksu un pēc iespējas plašāk to popularizē. Drukāti kodeksa eksemplāri sabiedrībai ir pieejami bez maksas.
3.7. Eiropas kodeksa administrators
LDSA shall publish the Code and make it known as widely as possible. Printed copies shall be made available free of charge to the public.
3.7. European Code Administrator
Eiropas kodeksa administratoru veido četru dalībnieku komiteja. Trīs no tiem ir no tiešās tirdzniecības sektora un tos ieceļ Seldia valde. Ceturtais dalībnieks, kuru arī ieceļ Seldia valde un kurš darbojas kā priekšsēdētājs, nav saistīts ar sektoru. Xxxxxx izpilddirektors saskaņā ar amata pienākumiem ir kodeksa administratora sekretārs. Eiropas kodeksa administrators var veikt vienu no nākamajā punktā minētajām darbībām, ja patērētāja dzīvesvieta ir EEZ dalībvalstī vai uzņēmums vai tiešais pārdevējs darbojas vienā no EEZ valstīm.
Eiropas kodeksa administrators var:
1) saņemt sūdzības un lemt par sūdzībām no personām (patērētājiem, tiešajiem pārdevējiem, tiešās tirdzniecības uzņēmumiem, patērētāju organizācijām utt.) no EEZ valstīm, kurās nav tādas TTA, kas ir Seldia biedre, ja minētās sūdzības attiecas uz tiešās tirdzniecības uzņēmumu, kas ir Seldia biedrs vai tādas TTA biedrs, kas ir Seldia biedre;
2) saņemt no personām sūdzības un lemt par sūdzībām, kas attiecas uz pārrobežu darījumiem un kurās ir iesaistīti EEZ valstu tiešās tirdzniecības uzņēmumi, kas ir Seldia biedri vai tādas TTA biedri, kas ir Seldia biedre;
3) saņemt sūdzības un pieņemt lēmumus par sūdzībām no TTA, kas ir Seldia biedre vienā no EEZ valstīm, ja minētās sūdzības attiecas uz tiešās tirdzniecības uzņēmumu, kas ir Seldia biedrs; un
4) saņemt sūdzības no TTA — Seldia biedrēm — no vienas no EEZ valstīm, kurā ir iesaistīti tiešās tirdzniecības uzņēmumi, kuri ir PTTAF, PTTAF ģenerāldirektorāta padomes biedri vai tādas TTA biedri, kas nav Seldia biedre, ar starpniecības mērķi kopā ar šādiem tiešās tirdzniecības uzņēmumiem, PTTAF un attiecīgo TTA.
3.8. Procedūras
The European Code administrator consists of a committee of four members. Three of them are from the direct selling sector and are appointed by the board of Seldia. The fourth member, also designated by the board of Seldia and acting as chairman, is independent from the sector. The Executive Director of Seldia is ex officio secretary of the Code Administrator.
The European Code Administrator can take one of the actions mentioned in the next paragraph where the consumer has his residence in a member state of the EEA or a company or a direct seller is active in one of the EEA countries.
The European Code Administrator may:
1. receive and decide on complaints from parties (consumers, direct sellers, direct selling companies, consumer bodies etc) from one of the EEA countries without a DSA in membership of Seldia involving a direct selling company in membership of Seldia or of a DSA in membership of Seldia
2. receive and decide on complaints from parties related to cross-border transactions and involving a direct selling company in membership of Seldia or of a DSA in membership of Seldia from one of the EEA countries
3. receive and decide on complaints from DSAs in membership of Seldia in one of the EEA countries involving a direct selling company in membership of Seldia and
4. receive complaints from DSAs in membership of Seldia from one of the EEA countries involving direct selling companies in membership of WFDSA, WFDSA CEO Council or of DSAs outside membership of Seldia with the aim of mediation together with such direct selling companies, WFDSA and the DSA in question.
3.8. Procedures

1. Information Gathering
Where, in response to a complaint, it is necessary to gather further information to determine the points of facts and of rules concerning the case, the Code Administrator shall inform the company concerned about the complaint and the identity of the complainant. The Code Administrator may ask the company and the complainant to supply further information. After examining the facts and in the light of the rules set in this Code, the Code
laikā kopš sūdzības saņemšanas pieņem lēmumu par to, kādas darbības būtu jāveic. 2. LTTA valde var xxxxxx publiskot atzinumu, ja to ir ierosinājis vai ieteicis kodeksa administrators. | Administrator will decide within three months after the complaint has been received, whether further action should be taken. 2. Other Procedures If the Code Administrator considers that there may be an infringement of the Code, it addresses a request to the Company concerned, requesting it to submit its observations within one month. The Company has to adopt within one Monte a position on the points of fact and of Code on which the Code Administrator bases its decision to open a procedure. In the light of the reply or absence of a reply from the Company the Code Administrator may decide to issue an opinion, clearly and definitively setting out the reasons why it considers there to have been incompliance with the Code and calling on the Company to comply with the Code within 3 months. The Board of LDSA can decide to make the opinion public, on a proposal or recommendation by the Code Administrator. |
