The adjustment is limited to the lesser of the increase in Consultant’s published rates charged to all clients for services similar to those services described in this Agreement, or the increase in the Consumer Price Index (CPI) (All Urban Consumers), West – Size Class B/C as of the anniversary date over the index prior to the commencement date of this Agreement.
The Developer shall at any time and as often as the Housing & Community Services Department, or the City or the Comptroller General, or the Department of Housing and Urban Development (hereinafter HUD) or the HUD Inspector General of the United States may deem necessary, make available all its records and data for the purpose of making audits, reviews, examinations, excerpts, and transcriptions.
The work to be performed under this contract is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. § 1701u (hereinafter Section 3).
The Subrecipient further agrees to comply with these “Section 3” requirements and to include the following language in all subcontracts executed under this Agreement: “The work to be performed under this Agreement is a project assisted under a program providing direct Federal financial assistance from HUD and is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended (12 U.S.C. 1701).
