Underlying Agreement definition

Underlying Agreement means an agreement that is an underlying agreement for the purposes of paragraph 48 or Schedule 6 to the Act.

  • Except as otherwise limited in this Agreement, provided that the description of Services in the Underlying Agreement contemplates the Business Associate providing Covered Entity Data Aggregation services, Business Associate may Use Protected Health Information to provide Data Aggregation services to Covered Entity as permitted by 45 CFR §164.504(e)(2)(i)(B).
