Replacement of an Index The Manager reserves the right, with the prior consent of the Trustee and the prior approval of the SFC and any other relevant regulator(s) and provided that in its opinion the interests of the Unitholders would not be adversely affected, to replace an Index with another index that is tradable and has similar objectives to the relevant Index, in accordance with the provisions of the Code and the Trust Deed.
The statements in these Conditions include summaries of, and are subject to, the detailed provisions of and definitions in the Trust Deed.
The Manager may, from time to time, waive or modify the above restrictions subject to the provisions of the Trust Deed.
In the case of such a substitution, the Trustee may agree, without the consent of the Securityholders, to a change of the law governing the Securities and/or the Trust Deed, provided that such change would not in the opinion of the Trustee be materially prejudicial to the interests of the Securityholders.
