Title Continuation definition

Title Continuation means a written notice issued by the Title Insurance Company (including their local title insurance abstractors) confirming the status of title as set forth in the Title Insurance Policy, which indicates that, since the last preceding Funding Date (or, if the current Funding is on the Closing Date, since the date hereof), there has been no change in the title of title to the Mortgaged Property and no Liens or survey exceptions (in the case of any updated or “as-built” survey that has been issued) not theretofore approved by the Required Lenders, which written notice shall contain no recorded mechanic’s liens except as approved by the Required Lenders or as otherwise subject to a Contest.
Title Continuation means an endorsement to a Title Insurance Policy indicating that, since the issuance of such Title Insurance Policy, there has been no change in the state of title to the applicable Property and no Liens or survey exceptions not theretofore approved by Agent as provided herein, which notice or endorsements shall contain no exception for inchoate mechanic’s liens and shall have the effect of continuing such Title Insurance Policy to the date of such endorsement and increasing the Title Insurance Policy to the Allocated Title Amount, after giving effect to any additional Loans made with respect to such Property.
Title Continuation means an endorsement to the Title Policy indicating that, since the last preceding Advance, there has been no change in the state of title to the Premises and no Liens or survey exceptions other than Permitted Encumbrances approved by Lender, which endorsement shall affirmatively insure that no mechanic's or supplier's Liens have attached, all of which shall have the effect of continuing the Title Policy, and insuring the continued priority of the Lien of the Mortgage, to the date of such Advance and increasing the coverage of the Title Policy by an amount equal to the Advance then being made if the Title Policy does not by its terms provide for such an increase. If available, such Title Continuation shall contain affirmative insurance that neither public nor private conditions, covenants or restrictions, if any, affecting the Premises have been violated and that all Taxes are current.

Title Continuation means an endorsement to the Title Policy indicating that, since the Closing Date or the most recent Title Continuation, as applicable, there has been no change in the state of title to the Premises (except for, in either case, Permitted Encumbrances) and no Liens or survey exceptions not theretofore approved by Agent as provided herein or otherwise permitted by this Loan Agreement, which endorsement shall contain no exception for inchoate mechanic’s liens and shall have the effect of redating the Title Policy to a date specified by Agent.
