By a simple majority vote, the Technical Panel shall render a written decision (the “Technical Panel Impact Determination”) within two (2) Business Days after its meeting determining the dispute submitted for its review, and such decision reflected in the Technical Panel Impact Determination shall be final and binding upon the Developer and University and not appealable. Each party shall be responsible for the payment of all fees and expenses of its consultant plus fifty percent (50%) of the fees and expenses of the Independent Consultant.
