Within five (5) days of execution of this Project Stipulation, the United States, acting through the United States Department of Justice, counsel representing those State Trustees who are parties in the Deepwater Horizon Oil Spill Multi- District Litigation (“MDL”), and BPXP shall file a notice of this Project Stipulation, for informational purposes only, with the MDL Court.
Additional information about the process that individual State Trustees used to screen potential projects is also included, as relevant, in Chapters 5-14.
If any amount due to the State Trustees under Paragraph 19 is not paid by the required date, Settling Party shall be in violation of this Settlement Agreement and shall pay to the State Trustees, as a stipulated penalty, in addition to the Interest required by Paragraph 24 (Interest on Late Payments), $250 per violation per day that such payment is late.
The Indenture Trustee and the Deed of Trust State Trustees shall not be liable for any error of judgment, nor for any act done or step taken or omitted, nor for any mistake of law or fact, nor for anything which they may do or refrain from doing in good faith nor generally shall the Indenture Trustee or the Deed of Trust State Trustees have any accountability hereunder except for their respective individual willful misconduct or negligence.
The Deed of Trust State Trustees or their successors or substitutes may appoint or delegate any one or more Persons as agent to perform any act or acts necessary or incident to any sale held by Deed of Trust State Trustees, including the posting of notices and the conduct of sale, but in the name and on behalf of a Deed of Trust State Trustee, its successor or substitute.
