Public Ways definition

Public Ways means streets, roads, and ways that are recorded in the Registry of Deeds, defined by metes and bounds, and are available for use by the general public. Such ways may be owned by the state or a municipality, or they may be privately owned by Customer(s). Similarly defined and recorded rights-of- ways located on or across Private Property may also be acceptable for the purpose of the Company to install, own, and maintain a Line Extension.
Public Ways means the present and future streets, avenues, boulevards, parkways, lanes, alleys, bridges, sidewalks, parks, easements, highways, and any other public place within the municipal corporate limits of the City, whether dedicated or not.
Public Ways or “Public Rights-of-Way” means the areas in, upon, above, along, across, under, and over the public streets, sidewalks, roads, lanes, courts, ways, alleys, boulevards, buildings and any other public places owned by and within the Township as the same now or may hereafter exist and which are under the permitting jurisdiction of the Township.

  • Grantee’s System shall be erected, placed, extended, repaired, laid or otherwise installed, operated and maintained in such a manner as will, consistent with reasonable necessity, cause the least interference with other existing public uses of the Public Ways, including but not limited to existing sewer, water, pipes, electricity, telephone wires, public or private drains, and any other facilities within the City and also including those utilities granted by franchise or permit by the City.

  • After the effective date of this franchise, Grantee’s main or lateral lines installed or replaced in Public Ways shall be installed or replaced at depths which comply with all applicable state and federal rules, regulations and company policies establishing minimum safety standards for the design, construction, maintenance and operation of pipelines.

  • If Grantor shall require the Grantee to adapt or conform its System or in any way to alter, relocate or change its property to enable any other person, firm, corporation or entity (whether public or private), other than the Grantor, to use the Public Ways, the Grantee shall be reimbursed by the person, firm corporation or entity desiring or occasioning such change for any and all loss, cost or expense occasioned thereby.

  • Grantor reserves the right to lay or permit to be laid cables, electric conduits, water, sewer, gas or other pipelines and to do or permit to be done any underground work deemed necessary and proper by the Grantor, along, across, over or under the Public Ways.


More Definitions of Public Ways

Public Ways means any highway, street, alley, utility easement (unless their use is otherwise restricted for other users), or other public Rights-of-way for motor vehicle or other use under the jurisdiction and control of the City.
Public Ways means the area on, below, or above any real property in City in which the City has an interest including, but not limited to any street, road, highway, alley, sidewalk, parkway, park, skyway, or any other place, area, or real property owned by or under the control of City, including other dedicated Rights-of-Way for travel purposes and utility easements.
Public Ways or “Public Rights-of-Way” means the areas in, upon, above, along, across, under and over the public streets, sidewalks, roads, lanes, courts, ways, alleys, boulevards, buildings and any other public places owned by and within the City as the same now or may hereafter exist and which are under the permitting jurisdiction of the City.
Public Ways means all dedicated public rights-of-way, streets, highways, and alleys of the Franchisors. “Public Ways” shall not include property of Franchisors which is not a dedicated public right-of-way, street, highway, or alley.
Public Ways means the surface, the air space above the surface and the area below the surface of any right-of-way and public street and any highway, lane, path, alley, sidewalk, bxxxxxxxx, xxxxx, xxxxxx, xxxx, xxxxxxx, waterway or other public right-of-way including public utility casements or rights-of-way in which the city has jurisdiction, and any temporary or permanent fixtures or improvements located thereon now or hereafter held by the City in which the City holds rights sufficient, without consent of any other party, to permit Grantee to use thereof for the purpose of installing or maintaining Grantee’s District Cooling Facilities. The term “Public Ways” shall be deemed not to include Chicago Freight Tunnels or the LaSalle Street Trolley Tunnel or any other tunnels except as specifically referred to herein.
Public Ways means the surface of and the space above and below any public street, road, highway, freeway, lane, path, public ways court, boulevard, parks, parkway, or drive owned by the City for the purpose of public use, and shall include other rights of way as are now held or hereafter held by the City which shall, within their proper use and meaning entitle the Provider to the use thereof for the purposes of installing, maintaining and operating Company Facilities.
Public Ways means the surface, the air space above the surface and the area below the surface of any public right-of-way, including, but not limited to, any street, highway, avenue, drive, boulevard, lane, path, alley, sidewalk, waterway, bridge, tunnel, park, parkway or other public right-of-way including public utility easements or rights-of-way over which the Village [City] has jurisdiction, and any temporary or permanent fixtures or improvements located thereon now or hereafter held by the Village [City] in which the Village [City] holds rights sufficient, without consent of any other Person, to permit Licensee the use thereof for the purpose of installing or maintaining Licensee's Electric System.
