Program Documents definition

Program Documents means this Agreement, the Custodial Agreement, any Servicing Agreement, the Electronic Tracking Agreement, the Master Netting Agreement, each Guaranty, the Pricing Side Letter, the Instruction Letters, if any, the Collection Account Control Agreement, any assignment of an Interest Rate Protection Agreement and any other agreement entered into by Seller, on the one hand, and Buyer and/or any of its Affiliates or Subsidiaries (or Custodian on its behalf) on the other, in connection herewith or therewith.

Program Documents or “Loan Documents” means the MMRB Loan Commitment, MMRB Loan Agreement, Note, Mortgage, Credit Enhancement, MMRB Land Use Restriction Agreement, trust indenture, preliminary and final official statements, intercreditor agreement, assignments, bond purchase agreement, compliance monitoring agreement, mortgage servicing agreement and such other ordinary and customary documents necessary to issue and secure repayment of the Bonds and the MMRB Loan sufficient to protect the interests of the Bond owners and the Corporation.

Program Documents means each Note, the Series Instrument, the Indenture, the Trust Agreement, the Administrative Services Agreement, the Support Agreement, the Name Licensing Agreement, the Distribution Agreement, the Terms Agreement, each Funding Agreement and any other documents, certificates, agreements or instruments entered into by, or with respect to, or on behalf of, the Trust.

Examples of Program Documents in a sentence

• Each of the Program Documents to which the Bank is a party and this Agreement, has been duly authorized by the Bank.

• This Agreement, the Program Documents, the Collateral Certificate and the Notes conform in all material respects to the descriptions thereof contained in the Prospectus.

• The Bank has full power and authority to execute and deliver the Program Documents to which it is a party, and to perform its obligations thereunder.

Program Documents means each Note, the Omnibus Instrument, the Indenture, this Agreement, the Administrative Services Agreement, the License Agreement, the Expense and Indemnity Agreement, the relevant Program Distribution Agreement, the Funding Agreements and any other documents or instruments entered into by, or with respect to, or on behalf of, the Trust.

Program Documents means the Indenture, the Underwriting Agreement, the Issuer Trust Agreement, the Issuer Administration Agreement, the Certificate of Trust, the 2016-2 Exchange Note Sale Agreement, the 2016-2 Exchange Note Transfer Agreement, the Titling Trust Agreement, the 2016-2 Exchange Note Supplement, the Credit and Security Agreement, the Basic Servicing Agreement, the 2016-2 Servicing Supplement, the 2016-2 Asset Representations Review Agreement, the Depositor Certificate of Formation, APGO’s trust agreement, the Depositor LLC Agreement and the Depositor Administration Agreement.

Program Documents. With respect to each Transaction, the related Purchase Price and Terms Letter, the related Warranty Xxxx of Sale, the Amended and Restated Master Servicing Agreement, the Custodial Agreement, this Agreement and each other document or instrument executed or delivered by Seller in connection with any of the foregoing.

Program Documents means this Agreement, the Collateral Security, Setoff and Netting Agreement, the Guaranty, the Side Letter, the Commitment Letter and any other agreement entered into by any of the Sellers and/or a Guarantor, on the one hand, and Buyer or one of its Affiliates on the other, in connection herewith or therewith.

Program Documents means this Agreement, the Pricing Letter, the Custodial Agreement, the Electronic Tracking Agreement, the Application, a Servicer Notice, if any, and the Power of Attorney.

Program Documents means this Agreement and the Loan Sale Agreement.
