The loads of KPP identified in Section 2.0 hereof as the Network Load are electrically located within the Sunflower Control Area.
KPP shall provide adequate reactive compensation for KPP’s Network Load to maintain at all times the load power factor at each of the delivery points shown in Appendix 2 between .95 lagging and .98 leading.
EPE’s obligation to accept and pay for any Product is subject to approval by the Network Service Provider of EPE’s (i) application for designation of the Facility or this Agreement as a Network Resource for EPE’s native load customers; (ii) application for designation of the Facility or this Agreement as a Network Load; each of (i) and (ii) above without conditions materially unsatisfactory to EPE or requirements of material transmission upgrades (collectively, the “NSP Approvals”).
