• The LNG Production Rate Performance Test shall be conducted in accordance with the LNG Production Rate Guarantee Conditions specified in Section 2.4 and the Performance Test Procedures specified in Section 2.5 of this Attachment S.

• Each LNG Train shall have an LNG Production Rate equal to or greater than *** MMbtu HHV (“LNG Production Rate Performance Guarantee”), produced over a 72 hour continuous period using the Measurement and Calculation Methods specified in Attachment S; provided that the LNG Production Rate Performance Guarantee Conditions stipulated in Attachment S are met.

Guarantee Conditions means the conditions and parameters in section 1.3.4 of SCHEDULE A (Owner's Technical Requirements).

Guarantee Conditions means the conditions upon which the Minimum Acceptance Criteria and Performance Guarantees are based and shall be tested, as further defined in Attachment T. “Guaranteed Dates” mean the Guaranteed Substantial Completion Date and the Final Completion Date. “Guaranteed Substantial Completion Date” has the meaning set forth in Section 5.3A. “Guarantor” means ▇▇▇▇▇▇▇ Global Energy, Inc. “Hazardous Materials” means any substance that under Applicable Law is considered to be hazardous or toxic or is or may be required to be remediated, including (i) any petroleum or petroleum products, radioactive materials, asbestos in any form that is or could become friable, urea formaldehyde foam insulation, transformers or other equipment that contain dielectric fluid containing polychlorinated biphenyls and processes and certain cooling systems that use chlorofluorocarbons, (ii) any chemicals, materials or substances which are now or hereafter become defined as or included in the definition of “hazardous substances,” “hazardous wastes,” “hazardous materials,” “extremely hazardous wastes,” “restricted hazardous wastes,” “toxic substances,” “toxic pollutants,” or any words of similar import pursuant to Applicable Law, or (iii) any other chemical, material, substance or waste, exposure to which is now or hereafter prohibited, limited or regulated by any Governmental Instrumentality, or which may be the subject of liability for damages, costs or remediation. “High Value Orders” has the meaning set forth in Attachment LL. “Honeywell” means Honeywell LNG LLC or their designated Affiliate, which is a Subcontractor providing certain Equipment and engineering services related to the wound coil aluminum heat exchangers LNG liquefaction units pursuant to the equipment purchase agreement between Contractor and Honeywell LNG LLC. “Honeywell License” has the meaning set forth in Section 10.7A. “Indemnified Party” means any Owner Indemnified Party or Contractor Indemnified Party, as the context requires. “Indemnifying Party” means Owner or Contractor, as the context requires. “Independent Engineer” means the engineer(s) employed by Owner or Lender.

Guarantee Conditions means the conditions defined in Material Requisition MRC-MUSG-00001, Appendix F for the Equipment Performance Guarantees, and as agreed between Buyer and Owner for the Facility Performance Guarantees.

Guarantee Conditions means - the fulfillment of the two following conditions, cumulatively: (1) repayment of the Chinese loan in full; as well as (2) repayment of the full credit to be obtained, if any is obtained, pursuant to Sections 12.7.4 (a) and 12.7.4 (b) of the Trust Deeds (the "Additional Credit") .
