Facility Improvements definition

Facility Improvements means, with respect to a Product, any improvements or changes (a) to the Manufacturing process used or services performed to Manufacture such Product that apply generally to all products Manufactured at the Manufacturing Facility and (b) that do not require updates to the regulatory dossiers for such Product or any other filings with any Regulatory Authority with respect to such Product.

Facility Improvements means those improvements to the MRF procured by Rockland Green in order to accommodate the Dual Stream Recyclables Processing System. Facility Improvements include (i) Contract No. 2 - General Construction, (i) Contract No. 3 - Mechanical/HVAC Work (covered by this Contract), (iii) Contract No. 4 - Plumbing Work, (iv) Contract No. 5 - Electrical Work, and (v) Contract No. 6 - a Fire Protection System.

Facility Improvements shall be as defined in Section 2.1(d).

Examples of Facility Improvements in a sentence

• Upon completion of the Facility Improvements, Tenant shall pay Landlord for the actual and reasonable costs of those Facility Improvements listed on Exhibit F within thirty (30) days of written request by Landlord accompanied by invoices substantiating the cost; provided that Tenant’s Obligation to pay for any Facility Improvements shall not equal or exceed Thirty Thousand Dollars ($30,000.00).

• The abatement shall equal to Tenant’s Rent for the period of time beyond the Facility Improvements Period that all or such portion of the Parking Facility is closed.

• Landlord shall cause the Facility Improvements to be completed within the first year of the Term and to be completed within three (3) days of commencement of the Facility Improvements (“Facility Improvements Period”).

• Tenant agrees that the activities related to the Facility Improvements shall not constitute an actual or constructive eviction of Tenant, a default by Landlord under this Lease or a violation of Tenant’s right of quiet enjoyment.

• Landlord will give Tenant thirty (30) days written notice prior to commencing work on the Facility Improvements.

Facility Improvements means new tangible assets and improvements to existing tangible assets which Gevo deems necessary to ensure that the Facility performs at full ethanol production capacity, together with all tangible assets related to the Retrofit.

Facility Improvements shall have the meaning described in Section 3(c) below.

Facility Improvements means improvements to the Beneficiary’s Senior Center infrastructure, which may include capital improvements to promote and encourage older adults to access Senior Centers. Improvements that encourage healthier living environments, outdoor recreation, socialization, connection amongst older adults and access to services and programs designed to mitigate the spread of COVID-19 or to respond to the negative public health effects of COVID-19. Examples of such improvements include, but are not limited to: building a covered outdoor seating area at the Senior Center for participants to allow for social distancing; upgrades to HVAC systems that provide better air filtration; building modifications to reconfigure or enlarge indoor spaces to allow for social distancing; or purchase of vehicles to provide transport to Senior Center and Senior Center activities to promote better access to the services provided by the Senior Center including, but not limited to, health services (including vaccines), social services, and social engagement.

Facility Improvements means the public improvements and infrastructure facilities for the Property as further described on Exhibit C attached hereto.

Facility Improvements means the “Facility Improvements”, as defined in Appendix A to the Existing Participation Agreement.

Facility Improvements or “Improvements” means the cabins, manager’s lodge, bathhouse, kitchen, dining lodge, museum, and related water system, related wastewater system, and access roads, the general grounds, and any additions thereto, and any adjacent land and/or structures temporarily used in connection with the Facility activities.

Facility Improvements means the following contemplated improvements: (x) development and construction of HREE refining capacity at the Mountain Pass Facility, (y) the development, construction and/or recommission of hydrochloric acid facilities at the Mountain Pass Facility and (z) the development and construction of the expansion of the Independence Facility capacity to 3,000 tons of Magnets annually.
