Data Room definition
Data Room means the virtual data room maintained by the Liquidator, created for the Qualified Bidders to access information in relation to the Company;
Data Room has the meaning set forth in Section 1.2.

The information relating to the customers of the Company, including the list of the customers of the Company, the amounts invoiced to each of them and the share of the Company’s sales represented by each of them for the twelve (12) months ended September 30, 2026, has been Fairly Disclosed to the Purchaser in the Data Room.
The information contained in (a) the Data Room, (b) the Disclosure Letter, (c) the written answers to questions raised by the Purchaser and its advisors during the DD Investigation (together, the “Disclosed Information”), shall be deemed disclosed to the Purchaser to the extent that they are Fairly Disclosed.

Data Room means the virtual data room created and maintained by the Liquidator for Qualified Bidder(s) to conduct the due diligence and to access the information & documents in relation to the Corporate Debtor under the terms of the Confidentiality Undertaking;
