Orders as part of services of advisory or management of portfolios of UCITS with different classes registered at the CNMV shall be processed for execution with the class that is most beneficial to the Customer, pursuant to the requirements of each class and, when applicable, will be carried out pursuant to the relevant Customer order.
The parties agree that any term or condition stated in a Customer purchase order or in any other Customer order documentation (excluding Order Forms) is void.
When orders are transmitted to third parties for execution, the Bank’s policy is based on selecting entities that have adopted order execution policies that conform to prevailing legislation and on taking into account the category of financial instrument for which the Customer order is issued.
Notwithstanding any language to the contrary therein, no terms or conditions stated in a Customer purchase order or in any other Customer order documentation (excluding Quotations) shall be incorporated into or form any part of this Agreement, and all such terms or conditions shall be null and void.
To ensure this will not occur, the Customer agrees to only place sell orders for securities owned by the Customer and held in the Customer Account at the time any Customer order is placed.
