Compliant Tender definition

Compliant Tender means a tender that meets all of the Qualification Criteria;

• If the Developer elects not to transfer the Energy System to an Affiliate pursuant to paragraph 2.1.1 above then, provided there is a Liquid Market, the Developer shall undertake the Tender Process in accordance with paragraph 4.2.
