Collection; Foreclosure Sample Clauses
The 'Collection; Foreclosure' clause defines the lender's rights and procedures for collecting outstanding debts and pursuing foreclosure if the borrower defaults on their obligations. Typically, this clause outlines the steps the lender may take to recover unpaid amounts, such as sending notices, initiating legal proceedings, or selling the collateral property through foreclosure. Its core function is to provide a clear legal framework for debt recovery, ensuring the lender can enforce their security interest and mitigate losses in the event of borrower default.

Any such sale may be made either at public or private sale at its place of business or elsewhere. Borrower agrees that any such public or private sale may occur upon ten (10) calendar days’ prior written notice to Borrower. Lender shall be deemed to have acted reasonably in the custody, preservation and disposition of any of the Collateral if it complies with the obligations of a secured party under the UCC.
