BEE Codes definition

BEE Codes means the Broad-Based Black Economic Empowerment Codes of Good Practice gazetted under the BEE Act;
BEE Codes means the Codes of Good Practice on Broad-Based Black Economic Empowerment published under section 9(1) of the BEE Act, as amended or revised from time to time;
BEE Codes means Broad-Based Black Economic Empowerment Codes of Good Practice issued in terms of section 9(1) of the BEE Act, as amended from time to time;

BEE Codes means the Codes of Good Practice on Broad-Based Black Economic Empowerment published in terms of the Republic of South Africa Government Gazette No. 36928 on 11 October 2013 under section 9(1) of the BBBEE Act as amended or replaced from time to time, and any sector code published in terms of the BBBEE Act having application to the Company;

BEE Codes means the Codes of Good Practice on Black Economic Empowerment gazetted on 9 February 2007 by the Department of Trade and Industry in terms of the BEE Act and the Codes of Good Practice on Black Economic Empowerment gazetted on 11 October 2013 by the Department of Trade and Industry in terms of the BEE Act, and in each case, any replacement or amended Codes of Good Practice. “BEE Entity” means a special purpose entity incorporated under the laws of South Africa and established in order to consummate a BEE transaction pursuant to which such entity may acquire up to 3% (three per cent) of the issued ordinary shares of Harmony Moab. “Blocking Law” has the meaning given to that term in Clause 20.23 (Sanctions and Anti- Corruption Laws). “Borrowers” means: (a) in respect of Facility A, the Company; and (b) in respect of Facility B, the Parent. “Break Costs” means any amount specified as such in the Reference Rate Terms. “Business Day” means a day (other than a Saturday or Sunday) on which banks are open for general business in Johannesburg, New York, Frankfurt (or the principal financial centre in the jurisdiction from which the Agent performs its obligations under this Agreement from time to time), London and in relation to: (a) any date for payment or purchase of an amount relating to a Loan or Unpaid Sum; or (b) the determination of the first day or the last day of an Interest Period for a Loan or Unpaid Sum, or otherwise in relation to the determination of the length of such an Interest Period), which is an Additional Business Day relating to that Loan or Unpaid Sum. “Buy-In Option” means the right of Papua New Guinea exercisable at any time prior to the commencement of mining to make a single purchase of up to a 30% (thirty per cent) equitable interest in any mineral discovery arising from any or all of Exploration Licences No EL 440 and EL 1105 and Exploration Licence Application ELA 1927 at a price pro-rata to the accumulated exploration expenditure thereon. “Cash” means, at any time, cash denominated in ZAR, USD, AUSD or PNGK in hand or in a bank account and (in the latter case) credited to an account in the name of a member of the Group with an Acceptable Bank and to which a member of the Group is alone (or together with other members of the Group) beneficially entitled and for so long as: (a) that cash is repayable within 90 (ninety) days after the relevant date of calculation;
BEE Codes means the Codes of Good Practice on BBBEE contemplated in section 9 of the BBBEE Act, as gazetted from time to time;
BEE Codes means the Broad-Based Black Economic Empowerment Codes of Good Practice gazette from time to time under the BEE Act in terms of Code 100-the Measurement of Ownership Element of Broad-Based Black Economic Empowerment
BEE Codes means the Codes of Good Practice on black economic empowerment contemplated in section 9 of the BBBEE Act, as gazetted from time to time;
