Severability Vzorová ustanovení

Severability. If any provision of this License Agreement shall be prohibited or adjudged by a court to be unlawful, void or unforceable, such provision shall, to the extent required, be severed from this Agreement and rendered ineffective without invalidating the remaining provisions of this Agreement and shall not in any way affect any other circumstances or the validity or enforcement of this License Agreement.

Severability. If any portion of this EULA is not enforceable, it will not affect any other terms.

Severability. If any provision in these Conditions is or becomes invalid, this shall not prejudice the applicability of all the other provisions of these Conditions.

Severability. Any provision in this Agreement determined by proper judicial authority to be invalid or unenforceable will be revised by agreement of the Parties to the extent necessary to avoid the remainder of the Agreement being invalid or unenforceable.

Severability. In the event that a court of competent jurisdiction finds any term or clause in this Agreement to be invalid, unenforceable, or illegal, the same will not have an impact on other terms or clauses in the Agreement or the entire Agreement. However, such a term or clause may be revised to the extent required according to the opinion of the court to render the Agreement enforceable or valid, and the rights and responsibilities of the parties shall be interpreted and enforced accordingly, so as to preserve their agreement and intent to the fullest possible extent.

Severability. If one or more provisions of the Agreement should be deemed invalid, all other provisions shall remain in force except where a legal ruling states that the nullity of a provision invalidates all other provisions. Moreover, the Parties shall then make all reasonable efforts to replace said provision by a provision complying with the applicable regulation and respecting as closely as possible the intent of the invalid original provision.

Severability. Should any provision of the Master Agreement or an Order be or become void, voidable, unenforceable, ineffective, or illegal in its terms, but would not be so if it were rewritten to eliminate such terms that were found to be void, voidable, unenforceable, ineffective, or illegal and such rewrite would not affect the intent of the provision, then the provision must be rewritten or replaced with an amendment to be enforceable and legal. The fact that such provisions are void, voidable, unenforceable, ineffective, or illegal shall not prejudice any other provisions of the Agreement. 23.4 Salvátorská klauzule. Pokud je nebo stane-li se některé ustanovení Rámcové smlouvy nebo jakékoliv Objednávky z hlediska svého znění neplatné, zrušitelné, nevymahatelné, neúčinné nebo nezákonné, ale nebylo by, pokud by byly přepracovány ty jeho části, které jsou považovány za neplatné, zrušitelné, nevymahatelné, neúčinné nebo nezákonné, a toto přepracování by nemělo vliv na záměr daného ustanovení, pak takové ustanovení musí být přepsáno, nebo nahrazeno dodatkem tak, aby bylo vymahatelné a v souladu se zákonem a tato neplatnost, zrušitelnost, nevymahatelnost, neúčinnost nebo nezákonnost se nedotýká ostatních ustanovení této Smlouvy.

Severability. Nothing contained in this Agreement shall be construed so as to require the commission of any act contrary to law, and if any provision of this Agreement is held to be invalid or illegal under any material statute, law, ordinance, order or regulation, in any jurisdiction, such provision shall be curtailed and limited only to the extent necessary to bring it within the legal requirements of such jurisdiction and such curtailment or limitation shall not affect the validity of the remainder of this Agreement or any other provisions hereof in that, or any other, jurisdiction.

Severability. If any provision of this Agreement is held by any Court or other competent authority to be invalid, illegal or unenforceable in whole or in part, the other provisions of this Agreement and the remainder of the affected provision shall continue to be valid.
