These Keysight Instant Buy Terms of Sale (“Terms of Sale”) govern the sale of Products and Service and the license of Software by Keysight Technologies Switzerland S.A. (“Keysight”) and shall, together with the quotation, purchase order in a form acceptable to Keysight and order acknowledgement, constitute the agreement with Customer (collectively, the “Sale Agreement”). “Hardware” means any standard hardware, including accessories sold under these Terms of Sale. “Software” means one or more computer programs, related documentation and all updates and upgrades thereto licensed under these Terms of Sale. “Service” means any standard support service to support Products, Software updates and maintenance, or training. “Product” means Hardware sold and Software licensed under these Terms of Sale. “Specifications” means technical information about Products published by Keysight and in effect on the date Keysight ships the order.
