Zoning Classification. The current zoning classification for the property is Commercial-2 (C-2). Seller and Xxxxxxx do not represent that the Property may be used for any particular purpose. Any uses of the Property must be approved by the authorities having jurisdiction. The sale of the Property is not subject to the buyer obtaining approvals for the use of the Property. Seller and Xxxxxxx do not represent that the Property can be used for suggested uses that may have appeared in current or past advertising.

Zoning Classification. Without limitation of Sections 7.1(o) and 7.3, Buyer acknowledges that the Real Properties are zoned as set forth in Schedule 10.13.
Zoning Classification. The Palisades Site is zoned as set forth in Schedule 4.19. Palisades, as currently operated, is not a nonconforming use (legal or otherwise). The Big Rock ISFSI, as currently operated, is a legal nonconforming use. Except as set forth on Schedule 4.19, Seller has not requested, applied for, or given its consent to, and Seller has no Knowledge of, any pending change in the zoning of the Real Property.
