While a member’s request for injury leave is pending, the member may use accrued but unused sick leave, vacation leave, or compensatory time, which time usage shall be re- credited to the member’s appropriate leave balance(s) upon certification by the Board of Trustees that injury leave has been approved. If injury leave is not approved by the Board of Trustees, the member will be charged the designated leave initially used.
While. (i) the Issuer has and shall have no obligation to sell the Notes to the Dealer or to permit the Dealer to arrange any sale of the Notes for the account of the Issuer, and (ii) the Dealer has and shall have no obligation to purchase the Notes from the Issuer or to arrange any sale of the Notes for the account of the Issuer, the parties hereto agree that in any case where the Dealer purchases Notes from the Issuer, or arranges for the sale of Notes by the Issuer, such Notes will be purchased or sold by the Dealer in reliance on the representations, warranties, covenants and agreements of the Issuer contained herein or made pursuant hereto and on the terms and conditions and in the manner provided herein.

While a Funding 1 Liquidity Facility Stand-by Drawing is outstanding, any amount that has been withdrawn from the Funding 1 Liquidity Facility Stand-by Account shall be repaid by crediting such amount to the Funding 1 Liquidity Facility Stand-by Account as if it were a Funding 1 Liquidity Drawing repayable in accordance with PARAGRAPH (A) above and the Funding 1 Liquidity Facility Stand-by Account shall be increased by the amount of the Funding 1 Liquidity Drawing repaid. For the avoidance of doubt, any repayment pursuant to this PARAGRAPH (B) shall not be applied to reduce the amount of the Funding 1 Liquidity Facility Stand-by Drawing.
While a unit member is rendering service to the District and is not on leave, any period of actual physical disability caused or contributed to by pregnancy, miscarriage, abortion, childbirth, and recovery, shall be treated as any other physical disability. Physical disability, for the purposes of this Article, shall be defined as a period during which the unit member is unable to perform all job-related duties.

While a Contract Employee may grieve any other matter under the Collective Agreement, such employee shall not be entitled to grieve the termination of their employment at the expiry of the term of their written contract, and is not entitled to just cause protection in respect to such a termination.
While a Employee is a probationary employee serving a qualifying period either the Employee or the Company may terminate the Employee’s employment at any time and or any reason (not limited to matters specified in this Agreement) by giving the Employee one (1) week’s notice or payment in lieu, unless the termination is for serious and willful misconduct which at common law justifies summary dismissal.
