WEIGHING, SAMPLING AND MOISTURE DETERMINATION. (a) Concentrate shall be weighed, sampled and moisture determined upon arrival of the Concentrate at Buyer’s Warehouse under the inspection of an internationally recognized supervision company appointed by Seller and Buyer and in lot sizes of approximately 250 (two hundred and fifty) wmt in accordance with international practice. All sampling costs shall be shared equally between Buyer and Seller. The final wet weight shall be the wet weight measured upon Delivery of the Concentrate at the Warehouse under the supervision of an internationally recognized supervision company less 0.35%. The moisture thus determined shall be final for settlement purposes.
WEIGHING, SAMPLING AND MOISTURE DETERMINATION. 13.1 The Concentrates will be weighed, sampled, and moisture will be determined upon arrival of the Concentrate at Buyer's works, in accordance with established practices and in the customary manner as outlined in Appendix A attached. The cost of these operations will be for the Buyer's account. Seller will have the right to be represented at its own expense. The weights and moistures so determined will be final for settlement.
WEIGHING, SAMPLING AND MOISTURE DETERMINATION. For the purpose of final settlement, sampling and moisture determination shall be carried out in Yerevan upon loading rail cars in accordance with standard international practices under the supervision of approved supervision companies. Weighing shall be determined by the Railway Xxxx of Lading weight and the resulting net dry weight shall apply for final settlement purposes and shall be final and binding on both parties. Buyer and Seller shall appoint an internationally recognized supervision company, to be mutually agreed, on a joint basis to represent them during these operations. The cost for the supervision charge shall be shared equally between Buyer and Seller. The sample lot size shall be five big bags. Representative sample with a minimum weight of 250 grams shall be taken from each lot. Five sets of samples shall be prepared and sealed in order to allow the following distribution unless otherwise agreed: - 2 set for the Seller - 2 set for the Buyer - 1 set for independent supervision company

The operations of weighing, sampling for moisture and moisture determination shall be carried out at the Receiving smelter by means of calibrated equipment and under full witnessing of the internationally recognized independent inspection company appointed by Seller. Samples shall be taken for each day’s deliveries and combined to form lots representing all deliveries for each week for purposes of determining moisture, and metal content. From each sampling lot, Seller shall be provided with three sealed samples and Buyer shall be provided with one sealed sample. In addition, at least two sealed samples shall be held by the Buyer, one for reserve and one for subsequent dispatch to umpire if required. Seller shall have the right to be present and/or be represented at these operations at Seller’s own expense. The weight shall be determined and documented by static weighing device (truck scale). The weights so determined shall be final for settlement.

WEIGHING, SAMPLING AND MOISTURE DETERMINATION. The operations of weighing, sampling and moisture determination shall be carried out at the Buyer’s warehouse in the usual technical manner. The moisture and the weight thus determined less a weight franchise of 0.50% (zero point five zero percent) shall be final and binding for settlement purposes, save for fraud or manifest error. Seller and Buyer shall appoint an internationally recognised supervision company on a joint basis to conduct these operations. The costs of these operations shall be shared equally between the parties. WEIGHING, SAMPLING AND MOISTURE DETERMINATION. Weighing, sampling, moisture determination for the purposes of determination of dry weight, and sample preparation shall be performed at the receiving smelter in accordance with such reasonable technical procedures as Buyer may determine having regard to the quality of the concentrate. Sample lot size shall be determined by Buyer in accordance with standard procedures. Each prepared sample shall be divided into four portions for analysis: one for Buyer, one for Seller, one for umpire and one for reserve. The umpire and reserve portions shall be carefully sealed and retained by Buyer. Seller has the right to be represented during such procedures by any person reasonably acceptable to Buyer. In the event the Seller is not so represented during such procedures, Seller shall be deemed to have waived the right to be represented only for that specific lot of material being weighed and sampled.
WEIGHING, SAMPLING AND MOISTURE DETERMINATION. Concentrate shall be collected into standard smelter lots by Falconbridge for settlement purposes, and each lot shall be considered a separate delivery hereunder. Weighing, sampling, moisture determination and sample preparation shall be carried out at the smelter(s) by Falconbridge in accordance with such reasonable technical procedures as Falconbridge may determine, having regard to the quality of the concentrate. The results of such procedures shall be conclusive. Provided Seller has given Falconbridge reasonable advance written notice, Seller shall have the right to be represented at such procedures by any person reasonably acceptable to Falconbridge; if such written notice has not been given to Falconbridge or if such representative is not present at the time of sampling, the Seller shall be deemed to have waived such right.
