Uptime Guarantee. In the event of Downtime (as defined below), the monthly fee payable for the Services shall be reduced as follows:
Uptime Guarantee. 5.5.1 Whinstone guarantees an uptime percentage (percentage of time to maintain uninterrupted performance of the total Customer Equipment) of [***]% and no more than [***] days of planned downtime due to loss of power, construction, or network outage.
Uptime Guarantee. Your Services may be eligible to the Exabytes Uptime Guarantee and may be eligible to Outage Event Credit in the form of a credit against future xxxx of amounts payable by You for the provision of the service subject to the Terms of Exabytes Uptime Guarantee Policy as published on Exabytes Website.

Third party monitoring service reports may not be used for justification due to a variety of factors including the monitor's network capacity/transit availability. The uptime of the server is defined as the reported uptime from the operating system and the Web Server which may differ from the uptime reported by other individual services. To request a credit, please visit xxxx://xxx.xxxxxxxxxxxx.xx.xx/accounts/submitticket.php to create a support ticket to our Billing department with justification [within thirty (30) days of the end of the month for which you are requesting a credit]. Uptime guarantees only apply to shared and reseller solutions. Dedicated servers are covered by a network guarantee in which the credit is prorated for the amount of time the server is down which is not related to our uptime guarantee.

The uptime of the server is defined as the reported uptime from the operating system and the Apache Web Server which may differ from the uptime reported by other individual services. Dedicated servers are covered by a network guarantee in which the credit is prorated for the amount of time the server is down which is not related to our uptime guarantee.
Uptime Guarantee. 11.1 The Supplier guarantees the following minimum uptime on the Products:
Uptime Guarantee. Now Media Group guarantees network and server uptime of 99.9% during any 12-month period. Guarantee is not applicable in cases where downtime is the result of (1) scheduled maintenance, (2) customer behavior or customer applications, or (3) circumstances where Now Media Group has no influence or control. Exceptions to the guarantee, in which no credits will be made, include, but are not limited to, (1) backbone provider failures, (2) restoration of backups, (3) movement of accounts, (4) issues at the fault of Customer or third party, (5) fiber-optic main line cuts, (6) DNS or Registrar issues with the Customer's domain name, (7) routing issues between the Customer's location and the data center, (8) issues with Customers's local ISP, (9) Denial of Service attack, (10) suspension of an account per our TOS, and (11) external issues such as acts of God, war, governmental bodies, insurrection, embargo, fire, strike, sabotage, flood and any other natural or unnatural events.
Uptime Guarantee. 11.1 The Supplier guarantees a minimum Uptime on the Product. Uptime is the opposite of downtime:
Uptime Guarantee. VHS has a 99.8% Uptime Guarantee on ALL website and Email hosting plans. Failure to provide this level of service automatically entitles our customer to receive compensation as stated in the first paragraph of this agreement. In the event of service disruptions caused by unlikely events such as earthquakes, other natural disasters, region or country wide Internet network failures due to complete power loss or any disruptions caused by acts of terrorism or war, VHS technical staff will try to restart normal services off site as quickly as possible. However, these types of service failures are excluded from the VHS Uptime Guarantee. Please Note: 99.8% Uptime Guarantee allows for 17.5 hrs downtime annually. (24 hrs * 365 days = 8760 hrs * 99.8% = 17.5 hrs)
