Updated Survey. Upon request of Purchaser before or after Closing, Seller will cause the Survey to be updated, at Seller's expense, to a current date and furnished to Purchaser, within a reasonable period of time after Closing.
Updated Survey. Seller has provided a copy of Seller’s most recent survey of the Real Property to Purchaser as part of Seller’s Deliveries. Seller has also delivered to Purchaser a new ALTA/NSPS survey for the Real Property (the “Updated Survey”). Upon receipt of the Updated Survey, Purchaser shall provide two (2) original Updated Surveys to Seller and one (1) to Title Company, each certified by the surveyor who prepares such Updated Survey. Purchaser shall have until the expiration of the Due Diligence Period to examine the same and to notify Seller in writing of its objections to any new matters disclosed by the Updated Survey that constitute new title exceptions. If and only if Purchaser shall give written notice of such objections to Seller within three (3) Business Days after Purchaser’s receipt of the Updated Survey (but in no event later than the expiration of the Due Diligence Period), such items shall be deemed “Disapproved Exceptions,” and the rights and obligations of Purchaser and Seller with regard to such Disapproved Exceptions shall be as set forth in Section 4(c) hereof.
Updated Survey. Seller has previously delivered to Purchaser an updated survey (the “Survey”). Purchaser may request such additional modifications or revisions, at Purchaser’s cost, to otherwise satisfy Purchaser’s objectives.
