UNE. 1.9.3 When CLEC converts an End-User currently receiving non-complex service from AT&T-21STATE, the normal service order charges will apply and any additions and/or changes made at the time of conversion will incur nonrecurring charges associated with said additions and/or changes.

UNE. 2.15 The Parties intend that this Attachment 251 (c)(3) UNEs contains the sole and exclusive terms and conditions by which CLEC will obtain 251 (c)(3) UNEs from AT&T. Accordingly, except as may be specifically permitted by this Attachment 251 (c)(3) UNEs, and then only to the extent permitted, CLEC and its affiliated entities hereby fully and irrevocably waive any right or ability any of them might have to lease any unbundled network element (whether on a stand-alone basis, in combination with other 251 (c)(3) UNEs (or otherwise), with a network element possessed by CLEC, or pursuant to Commingling or otherwise) directly from any AT&T tariff, and agree not to so lease or attempt to so lease from any such tariff. Without affecting the application or interpretation of any other provisions regarding waiver, estoppel, laches, or similar concepts in other situations, the failure of AT&T to enforce the foregoing (including if AT&T fails to reject or otherwise block orders for, or provides or continues to provide, unbundled network elements, or otherwise, under tariff) shall not act as a waiver of any part of this Section, and estoppel, Page 95 of 315 ATTACHMENT 6: UNBUNDLED NETWORK ELEMENTS PAGE 10 OF 28 AT&T ILLINOIS/NAVIGATOR TELECOMMUNICATIONS, LLC. 071806 laches, or other similar concepts shall not act to affect any rights or requirements hereunder. At its option, AT&T may either reject any such order submitted under tariff, or without the need for any further contact with or consent from CLEC, AT&T may process any such order as being submitted under this Appendix 251 (c)(3) UNE and, further, may convert any element provided under tariff, to this Appendix 251 (c)(3) UNE, effective as of the later in time of the (i) Effective Date of this Agreement/Amendment, or (ii) the submission of the order by CLEC.

UNE. SBC Wisconsin believes that it is not required to include Section 271 network elements in any Commingled Arrangement, even those that include one or more Section 251(c)(3) UNEs. In contrast, CLEC believes that as long as a Commingled Arrangement includes one or more Section 251(c)(3) UNEs, SBC Wisconsin must commingle Section 271 elements with such UNE(s) if requested by CLEC. Without waiving any rights and without prejudice to any position CLEC may take in a subsequent proceeding, for purposes of this Amendment, CLEC agrees that it will not order, and SBC Wisconsin shall not be required to provision, Commingled Arrangements that include one or more Section 271 network elements. SBC Wisconsin agrees that CLEC's agreement in this section shall not constitute a precedent that can be used against CLEC in any proceeding except a proceeding to clarify and/or interpret this Agreement, including this Amendment.
