Trade Rules. All purchases and sales made hereunder shall be governed by the Feed Trade Rules of the National Grain and Feed Association unless otherwise specified. Said Trade Rules, a copy of which is appended hereto as Exhibit A, shall, to the extent applicable, be a part of this Agreement as if fully set forth herein.
Trade Rules. This Agreement shall be governed by the then-current Feed Trade Rules of the National Grain and Feed Association (the “Trade Rules”), unless otherwise specified. In the event the Trade Rules and the terms and conditions of this Agreement conflict, this Agreement shall control.
Trade Rules. Customer acknowledges that the Products and Services may be subject to the trade control laws and regulations of the United States and other national governments, and Customer agrees to comply with them.
Trade Rules. As may be applicable, all purchases and sales of Raw Grains made hereunder shall be governed by the Grain Trade Rules of the National Grain and Feed Association, unless otherwise specified. Said Trade Rules, shall to the extent applicable, be a part of this Agreement as if fully set forth herein. Notwithstanding the foregoing, the Arbitration Rules of the National Grain and Feed Association shall not be applicable to this Agreement and nothing herein contained shall be construed to constitute an agreement between the parties to submit disputes arising hereunder to arbitration before any organization or tribunal.
Trade Rules. All purchases and sales of Distiller’s Grains made hereunder shall, to the extent they are otherwise expressly applicable, be governed by the Feed Trade Rules of the National Grain and Feed Association unless otherwise specified, and said Trade Rules shall, to the extent expressly applicable, be a part of this Restated Agreement as if fully set forth herein; provided, however, that in the event of a conflict or inconsistency between any term or provision of such Trade Rules and any term or condition of this Restated Agreement, this Restated Agreement shall govern and control to the full extent of such conflict or inconsistency. Notwithstanding the foregoing, the Arbitration Rules of the National Grain and Feed Association shall not be applicable to this Restated Agreement and, except as provided in Section 20 below, nothing herein contained shall be construed to constitute an agreement between the parties to submit disputes arising hereunder to arbitration before any organization or tribunal.
Trade Rules. (a) A Team shall not be permitted to receive in connection with any trade, directly or indirectly, any cash or other compensation, including cash or other compensation received as reimbursement for Base Salary obligations to players whom the Team is acquiring.
Trade Rules. The Grain Trade or Feed Trade Rules (as applicable) promulgated, from time to time, by the National Grain and Feed Association (“NGFA”) shall be applicable, except as otherwise provided by these Sales Terms. Rule 20 of the NGFA Feed Trade Rules shall not apply.
Trade Rules. The sale of Product to Buyer is made under, and is subject to, the trade rules or trade industry form contract identified in the Confirmation of Terms (such trade rules or form contract as amended and in effect from time to time, the “Trade Rules”), which are incorporated herein by this reference, except to extent the same are contradicted by these Terms. In the event of a conflict between these Terms and the Trade Rules, these Terms will govern. As used in the Confirmation of Terms, “AFOA” refers to the American Fats and Oils Association, and AFOA’s Trade Rules shall be those pertaining to Vegetable Oils (Domestic & Import Contract); “FOSFA” refers to Federation of Oils, Seeds and Fats Association Limited; “GAFTA” refers to The Grain and Feed Trade Association; and “NGFA” refers to the National Grain and Feed Association and NGFA’s Trade Rules shall be its Feed Trade Rules. Specific Terms Applicable to Sales under FOSFA 32: Quality, conformance to Specifications and weight of Product, as specified in the terms/clauses of FOSFA 32 titled Quality, Specifications and Weight, respectively, shall be determined at the place and time of stuffing/loading of the Product. Sampling of the Product, as specified in the term/clause of FOSFA 32 titled Sampling, shall be conducted based on samples taken at the time and place of stuffing/loading of the Product. The following terms/clauses of FOSFA 32 shall be deemed deleted and are not applicable to this Contract: Declaration of Destination; and Extension of Time for Handing Over.
Trade Rules. All purchases and sales of Distiller’s Grains under this Agreement shall be governed by the Feed Trade Rules of the National Grain and Feed Association (as amended from time to time, the “Trade Rules”) if and only to the extent that the Trade Rules are expressly applicable to such purchases and sales; provided, however, that in the event of any conflict or inconsistency between any term or provision of the Trade Rules and any term or condition of this Agreement, this Agreement shall govern and control to the full extent of such conflict or inconsistency. Notwithstanding the foregoing, the Arbitration Rules of the National Grain and Feed Association shall not apply to this Agreement.
Trade Rules. 1. Employees working within the jurisdiction of this Local Union shall wear reasonably clean, white working clothing.
