Third Party Users. If required by Applicable Laws and Regulations or if the Parties mutually agree, such agreement not to be unreasonably withheld, to allow one or more third parties to use the Connecting Transmission Owner’s Attachment Facilities, or any part thereof, Developer will be entitled to compensation for the capital expenses it incurred in connection with the Attachment Facilities based upon the pro rata use of the Attachment Facilities by Connecting Transmission Owner, all third party users, and Developer, in accordance with Applicable Laws and Regulations or upon some other mutually-agreed upon methodology. In addition, cost responsibility for ongoing costs, including operation and maintenance costs associated with the Attachment Facilities, will be allocated between Developer and any third party users based upon the pro rata use of the Attachment Facilities by Connecting Transmission Owner, all third party users, and Developer, in accordance with Applicable Laws and Regulations or upon some other mutually agreed upon methodology. If the issue of such compensation or allocation cannot be resolved through such negotiations, it shall be submitted to FERC for resolution.

Third Party Users. For the purpose of operating Customer’s business, the parties intend that certain unrelated third parties with whom the Customer has a business relationship such as a supplier or customer and the employees of such third person (hereunder “Business Third Parties”), will have limited right to use certain Components of the Licensed Course Content solely for the purpose of providing services to Customer. All such services will be solely for the benefit of Customer’s internal business operations. The Business Third Parties may not utilize the Licensed Course Content for other than the direct benefit of Customer’s internal benefit, in accordance with the terms of this agreement and the customer shall assure third party compliance with this provision and the terms of this agreement.

For purposes of this Article 9.9.2, the phrase “third party users” shall mean other Interconnection Customers whose Generating Facilities are interconnected to and use the same Transmission Provider’s Interconnection Facilities (including, but not limited, to Transmission Provider to the extent that it is an Interconnection Customer whose Generating Facility is interconnected to and uses the same Transmission Provider’s Interconnection Facilities). Subject to the confidentiality provisions of Article 22 of this GIA and Section 13.1 of Transmission Provider’s GIP, Transmission Provider shall provide notice to Interconnection Customer if Transmission Provider intends to allow one or more third-parties to use the same Transmission Provider’s Interconnection Facilities which are used to serve Interconnection Customer. Third Party Users. Third-party users of Customer’s services have no privity of contract with Microsoft, and must exercise their rights to their own data that may be contained in Customer Data by working directly with Customer. Any third-party seeking to enforce their rights to their own data contained in Customer Data may retain possession and control of their own third-party generated content and may review personally identifiable information and correct erroneous information, by requesting Customer staff assist them in obtaining possession and control, and/or in reviewing/correcting content/information.

Third Party Users. 4.1 Customer may designate one or more Third-Party Users as required to facilitate Customer’s permitted use of the Products, provided that use and access by any Third-Party User must be under obligation of non-disclosure consistent with Section 16 (Confidentiality), solely for Customer’s or its Subsidiary’s internal business operations and benefit, and otherwise subject to the terms of the Agreement. Customer accepts responsibility for the acts or omissions of such Third- Party Users as if they were its own and agrees to enforce (and to assist Dynatrace in enforcing) the terms of the Agreement against Third-Party Users.
