Testing and Evaluation. SBL or vendors qualified by SBL shall perform all testing and evaluation of Raw Materials as required by the Specifications for the Raw Materials and the cGMPs, as further described in the applicable QAG, if applicable.

SBL shall perform testing of the Client Materials in accordance with the applicable QAG and/or Client’s instruction prior to the performance of the Manufacturing hereunder, in order to determine whether such Client Materials meet the Specification described in the applicable QAG (if applicable). SBL shall inform Client of (a) any damage to the Client Materials received that is visually obvious (e.g., damaged or punctured containers and temperature monitoring results outside of predetermined Specifications) within five (5) Business Days after SBL’s receipt of the Client Materials and (b) any non-conformance of the Client Materials to Specification either: (i) within sixty (60) calendar days after SBL’s receipt of the Client Materials or (ii) if release testing of Client Materials is not to be performed until it is needed for Manufacture, within sixty (60) calendar days after such release testing is performed; or (iii) as is otherwise agreed between the Parties. If, prior to performing any Service on the Client Materials, SBL determines that such Client Materials are defective or damaged, SBL shall not perform the Service on such Client Materials and shall follow Client’s written instructions regarding disposal or return of such Client materials to Client, such disposal or return to be at Client’s discretion and cost.

Testing and Evaluation. INTERTEK is an independent laboratory providing testing and evaluation services to determine whether representative samples of a Product comply with designated national and international standards, specifications and/or codes. The Client understands and agrees that INTERTEK has only tested or evaluated the submitted Product samples and does not guarantee or warrant the quality or compliance of all units of the Product manufactured or produced by the Client. The Client further acknowledges that as an independent laboratory, INTERTEK assumes no responsibility for the design of the Product.

LESSEE shall conduct such tests as it deems appropriate in order to determine whether Refuse Gas and/or Constituent Products can economically be recovered from the Landfill in Commercial Quantities. LESSEE, at its sole expense, will commence testing and evaluation of the Landfill for Refuse Gas and/or Constituent Products and complete a technical and economic feasibility study in accordance with the New Project Schedule. A copy of said feasibility study will be provided LESSOR upon completion, with materials deemed proprietary by LESSEE deleted, or at XXXXXX's option, with such materials included subject to the prior execution by XXXXXX of a suitable confidentiality agreement.

End User agrees that any Software that Xxxxxxxx offers to End User for the End User’s trial, testing and evaluation purposes are subject to the Trial Terms, which the End User is deemed to have accepted for each trial, test or evaluation that is undertaken by the End User in the End User’s network. Such Software must only be trialed, tested and evaluated by the End User. End User agrees that Xxxxxxxx may trial, test and evaluate Sandvine products in the End User’s network from time to time subject to the Product Evaluation Terms, which the End User is deemed to have accepted for each trial, test or evaluation that is undertaken by Xxxxxxxx.
