Continued acceptability of the reliability of the System’s performance shall be based on the Department’s experienced rate of recoverable and non-recoverable System operating errors or failures that preclude productive Department use of the System according to the requirements of this Contract and Contractor operating specifications.

Except under emergency conditions, Seller shall give Purchaser at least two hours advance notice of desired interruption and/or curtailment and at least one hour’s notice when interruption and/or curtailment are to be discontinued. If an interruption or curtailment under this Section 4.2 occurs during Curtailment Hours, the hours of curtailment or interruption under this Section will reduce the Curtailment Hours otherwise available during the same Curtailment Day. The required reliability (Computed % Reliability) for the System (exclusive of scheduled and routine maintenance) during any calendar month is ninety-nine point nine percent (99.9999%) uptime availability for aforesaid productive Department use, computed as follows: (Available-Time-per-Month) - (Downtime-per-Month) Computed % Reliability = ------------------------------------------------------------------- (Available-Time-per-Month) with Available-Time-per-Month equated to 24 hours times the number of days in the month, which shall be deemed to correspond to POP during each calendar month and Downtime-per-Month equated to those hours of Available-Time-per-Month during which the Department or any specific site is precluded from aforesaid productive System use. EXAMPLE: Given: Available-Time-per-Month was 720 hours. Downtime per-Month was 3.60 hours. (720 – 3.60) Then: Computed % Reliability = -------------------- = 99.5% 720 A given instance of System downtime shall start after receipt by the Contractor of a Department service request to remedy any operational System deviation, error, or failure condition(s), and end with documented proof, reasonably acceptable to the Department by Contractor to the Department that such System status has been fully restored to the applicable agreed operational specifications and made ready for productive Department use. However, the calculated time period of such an instance of System downtime shall exclude the following periods: Any nonproductive System use time caused by the Department or the Department's authorized third party and not related to a deficiency in the System. Any time during which the Department fails to make the System available for Contractor's remedial service. Any downtime investigated by Contractor which is then determined by the Contractor and the Department to be a non-downtime instance following such investigation.
System Reliability. Notwithstanding any other provisions herein, the Transmission Provider reserves the right, consistent with Good Utility Practice and on a not unduly discriminatory basis, to curtail Network Integration Transmission Service without liability on the Transmission Provider's part for the purpose of making necessary adjustments to, changes in, or repairs on its lines, substations and facilities, and in cases where the continuance of Network Integration Transmission Service would endanger persons or property. In the event of any adverse condition(s) or disturbance(s) on the Transmission Provider's Transmission System or on any other system(s) directly or indirectly interconnected with the Transmission Provider's Transmission System, the Transmission Provider, consistent with Good Utility Practice, also may curtail Network Integration Transmission Service in order to (i) limit the extent or damage by the adverse condition(s) or disturbance(s), (ii) prevent damage to generating or transmission facilities, or (iii) expedite restoration of service. The Transmission Provider shall give the Network Customer as much advance notice as is practicable in the event of such Curtailment. Any Curtailment of Network Integration Transmission Service shall be not unduly discriminatory relative to the Transmission Provider's use of the Transmission System on behalf of Native Load Customers. The Transmission Provider shall specify the rate treatment and all related terms and conditions applicable in the event that the Network Customer should fail to comply with established Load-Shedding and Curtailment procedures.
System Reliability. The ISO shall have primary responsibility for ensuring short-term reliability of the System consistent with the applicable standards set by NERC and the NPCC. The ISO may direct any NEPOOL Participant to take any action necessary to preserve the reliable operation of the NEPOOL Control Area under the circumstances and in the manner set forth in the Tariff and the System Rules and Procedures.

System Reliability. Notwithstanding any other provisions of this section, a TSP may, consistent with good utility practice and on a non-discriminatory basis, interrupt transmission service for the purpose of making necessary adjustments to, changes in, or repairs to its lines, substations and other facilities, or where the continuance of transmission service would endanger persons or property. In exercising this power, a TSP's liability shall be governed by §25.214 of this title (relating to Terms and Conditions of Retail Delivery Service Provided by Investor Owned Transmission and Distribution Utilities). In addition, notwithstanding any other provisions of this section, ERCOT may cause the interruption of transmission service for the purpose of maintaining ERCOT system stability and safety. In exercising this power, ERCOT shall not be liable for its ordinary negligence but may be liable for its gross negligence or intentional misconduct when legally due.
