SPECIFIED HOLIDAYS. 11.01 For the purposes of this article the following shall be specified as holidays under this Agreement and "holiday" means: New Year's Day Good Friday Easter Monday Victoria Day Thanksgiving Day Christmas Day Boxing Day and the half day immediately before Christmas Day and the half day immediately before New Year's Day, unless any such days are school days, or such day as may be established as a holiday in lieu of any said days by statute, statutory regulation, proclamation or similar authority or by the Board and any named holiday added to The Education Act of Ontario or to its regulations and enjoyed by the Board's students. If the Board determines that where a holiday falls on a non-working day that a working day not later than the next annual vacation of the employee shall be the holiday in lieu thereof, then for the purpose of this Agreement such substituted day shall be regarded as the employee's holiday notwithstanding the foregoing. It is understood that since the employees are not required to work during the months of July and August, they are not entitled to receive any holiday pay for Canada Day, Simcoe Day or Labour Day.
SPECIFIED HOLIDAYS. 13.01 An employee shall receive the following specified holidays with pay: New Year's Day Civic Holiday Family Day Labour Day Good Friday Thanksgiving Day Victoria Day Christmas Day Canada Day Boxing Day In order to qualify for specified holiday pay, the employee must work his scheduled shifts on each of the work days immediately preceding and immediately following the holiday concerned, unless he has a justifiable reason. The employees shall receive the benefit of any additional holiday that may be proclaimed by the Government during the life of the Agreement.

SPECIFIED HOLIDAYS. 13.1 Each permanent and temporary employee covered by this Agreement is entitled to twelve (12) paid Specified Holidays regardless of the day on which the Holiday occurs, and who has worked their regular shift on their regular work day preceding such Holiday and the regular work day succeeding such Holiday, or has obtained authorized leave of absence for such work day, the Corporation has agreed to pay compensation and provided further that such permanent or temporary employee works on such day if they are scheduled to do so. The Holidays to which this will apply are: New Year's Day; Family Day, Good Friday; Easter Monday; Victoria Day; Canada Day; Civic Holiday; Labour Day; Thanksgiving Day; Remembrance Day; Christmas Day; Boxing Day. If the Holiday falls within the employee's annual vacation the employee may take an extra day off (lieu day) or extra day's pay, within the same calendar year. The decision as to which shall apply must be made by the employee during the vacation signup. The individual scheduling of lieu days will be on a first request basis and requires mutual agreement of the employee and the Manager and/or requirements and scheduling priorities. All permanent and temporary employees covered by this Collective Agreement shall be granted an additional paid holiday called a Floater Holiday. The individual scheduling of this Floater holiday will be on a first request basis and requires mutual agreement of the employee and the respective Manager and/or requirements and scheduling priorities. The following qualifications will apply to the Floater Holiday.

Provided also, that a permanent and temporary employee works on a Specified Holiday if they are scheduled to do so. Said Specified Holidays shall be: New Year's Day, Family Day, Good Friday, Easter Monday, Victoria Day, Canada Day, Civic Holiday, Labour Day, Thanksgiving Day, Remembrance Day, Christmas Day and Boxing Day. Half (1/2) day and half Christmas Eve (1/2) day New Year's Eve, when Christmas Eve or New Year's Eve fall on a weekday, i.e. Monday through Friday. 1/2 day will be defined as commencing at the halfway point of the employee's shift, and will apply to employees working day shift only. See Appendix D. An additional paid Holiday called a Floater Holiday shall be granted upon mutual agreement of an employee and Department Manager or Nominee. The following qualifications will apply to the Floater Holiday.

New Year's Day Victoria Day Thanksgiving Day Second Monday in February Dominion Day Christmas Day Good Friday Civic Holiday Boxing Day Easter Monday Labour Day Second Monday in November Statutory Holiday shall be defined as a shift where the majority of hours worked fall between midnight hours beginning the agreed holiday and midnight hours of its termination. Time off in lieu of statutory holidays will be given within on month of the Holiday unless it is mutually agreed between the employee and the Hospital that such holiday be taken at another time. The Hospital will pay for the lieu day at the employee's basic straight time hourly rate of pay. An employee may elect to change his time off in lieu of four statutory holidays from these provided in the schedule without loss of pay providing that this election does not create an overtime payment, violate the labour code, be taken on an already scheduled statutory holiday, or during the Christmas-New Year season. These Lieu days will be scheduled by agreement between the employee and supervisor. Where a statutory holiday occurs during an employee's vacation period, the unused vacation time will be retained in his vacation bank. The hospital will endeavour to grant, where possible, either Christmas Day or New Year's Day off. Scheduling provisions may be waived to facilitate one of these days off. If this is not possible, equally qualified employees in the same department may exchange shifts to accommodate either Christmas or New Year‘s Day off, with the approval of their supervisor. Assignment of time off to be determined by personal choice and time off the previous year. These factors being equal, seniority shall prevail. This shall not affect the number of employees allowed to take vacation during this period. . The assignment of time off in the first year of agreement and when there is a conflict shall be resolved on a departmental seniority basis.
