The Sick Time Off—Use clause defines the conditions under which employees are permitted to take paid or unpaid leave due to illness or medical needs. Sick Time Off – Use. Sick time off shall be allowed an employee under the following conditions. (1) Because of and during illness, disability or injury which has incapacitated the employee from performing required duties. (2) By reason of exposure of the employee to a contagious disease during such period as attendance on duty would jeopardize the health of fellow employees or the public. (3) Because of a health condition of a family member that requires treatment or supervision, or that requires the presence of the employee to make arrangements for extended care. Family members includes biological, adoptive, de facto, or ▇▇▇▇▇▇ parent, stepparent, or legal guardian of an employee or the employee’s spouse or domestic partner, or a person who stood in loco parentis when the employee was a minor child; sibling, spouse, domestic partner, grandparent, grandchild, or child, regardless of age or dependency status, including a biological, adopted or ▇▇▇▇▇▇ child, stepchild, or a child to whom the employee stands in loco parentis, is a legal guardian, or is a de facto parent. Family members include those persons in a “step” relationship. (4) To provide emergency child care (as in Article 25) or because of condolence or bereavement (as in Article 26) (5) For personal medical, dental, or optical appointments or for family members’ appointments when the presence of the employee is required, if arranged in advance with the Employer. (6) When an employee is required to be absent from work to care for members of the employee’s household or family members because of emergencies not covered above. (7) When requested as a supplemental benefit while receiving a partial wage replacement for paid family and/or medical leave under Title 50A RCW. This time off may be subject to verification that the employee has been approved to receive benefits for paid family and/or medical leave under Title 50A 15 RCW. (8) If the employee or the employee’s family member is a victim of domestic violence, sexual assault, or stalking as defined in RCW 49.76.

The Employer may authorize sick time off use as provided in this subsection for other than family members. d) To care for a child under the age of eighteen (18) with a health condition that requires treatment or supervision, or to make arrangements for extended care. e) Because of illness or injury of a family member who is a person of disability and requires the nurse’s presence to provide short-term care or to make arrangements for extended care. f) To provide emergency child care for the nurse’s child. g) Because of a family member’s death that requires the assistance of the nurse in making arrangements for interment of the deceased. h) For personal medical, dental, or optical appointments or for family members’ appointments when the presence of the nurse is required, if arranged in advance with the employing official or designee.

The Employer may authorize sick time 41 off use as provided in this subsection for other than family members. 43 d) To care for a child, as defined under section 15.2 above, under the age of 44 eighteen (18) with a health condition that requires treatment or 45 supervision, or to make arrangements for extended care. 1 e) Because of illness or injury of a family member who is a person of 2 disability and requires the nurse’s presence to provide short-term care or 3 to make arrangements for extended care. 5 f) To provide emergency child care for the nurse’s child. 7 g) Because of a family member’s death that requires the assistance of the 8 nurse in making arrangements for interment of the deceased. 10 h) For personal medical, dental, or optical appointments or for family 11 members’ appointments when the presence of the nurse is required, if 12 arranged in advance with the employing official or designee. 14 2) Sick time off may be granted for condolence or bereavement. 16 3) In accordance with the Washington Family Care Act, RCW 49.12, RNs shall 17 be allowed to use any or all of their choice of sick time off or other paid time 18 off to care for their (a) child with a health condition that requires treatment or 19 supervision or (b) spouse, parent, parent-in-law or grandparent who has a 20 serious health condition or an emergency condition. Nurses shall not be 21 disciplined or otherwise discriminated against because of the exercise of 22 these rights.

(4) When the employee’s place of business has been closed by order of a public official for any health-related reason, or when an employee’s child’s school or place of care has been closed for such reason or after the declaration of an emergency by a local or state government or agency, or by the federal government. (5) Because of a health condition of a family member that requires treatment or supervision, or that requires the presence of the employee to make arrangements for extended care.

Such verification or proof may be given to the 8 a) Because of and during illness, disability or injury which has 9 incapacitated the employee from performing required duties. 10 b) By reason of exposure of the employee to a contagious disease during 11 such period as attendance on duty would jeopardize the health of fellow 12 employees or the public. 13 c) Because of a health condition of a family member that requires 14 treatment or supervision or that requires the presence of the employee 15 to make arrangements for extended care. The Employer may authorize 16 sick leave time off use as provided in this subsection for other than 17 family members. The applicability of "emergency," "necessary care" 18 and "extended care" shall be made by the Employer. 19 d) To provide emergency child care for the employee's child. 20 e) Because of a family member's death that requires the assistance of the 21 employee in making arrangements for interment of the deceased. 22 f) For personal medical, dental, or optical appointments or for family 23 members' appointments when the presence of the employee is 24 required, if arranged in advance with the employing official or designee. 25 g) When the employee’s workplace has been closed by a public official for 27 h) When the employee’s child’s school or place of care has been closed 28 by a public official for any health related reason or after the declaration 29 of an emergency by a local or state government or agency, or by the 30 federal government. 31 i) For reasons related to domestic violence, sexual assault or stalking that 32 affect the employee, the employee’s family member or a person with 33 whom the employee has a dating relationship. 34 j) For condolence or bereavement.
