Sewerage. The Company must progressively provide sewerage facilities within the Development Area and connection to temporary treatment facilities as may be required by the Water Authority of Western Australia. Such temporary treatment facilities will be operated by the Water Authority of Western Australia. The Company must provide, or pay the Water Authority of Western Australia for the provision of (at the Water Authority of Western Australia’s option) all reticulation sewers. Other facilities must be provided in accordance with the Water Authority of Western Australia’s policy and standards.
Sewerage. The entire sewage of the Project will be treated by the modern sewage treatment technology. This will efficiently treat the sewage and provide clean treated water at the end, which may be used for horticulture purposes. All the Units in the Project are to be connected to this system. Sewerage. Each property will be provided with one permanent sewer connection point.
Sewerage. The new terminal will be supported by the installation of a packaged sewerage treatment plant sized to support the 2028 loads. The plant shall be modularly expandable to process loads beyond 2028. The existing communications duct bank to the existing terminal will be relocated prior to construction of the new terminal. The existing electrical duct bank, (which follows a similar alignment to the existing communications duct bank) will be relocated prior to constructions of the new terminal. Storm water from the terminal shall be captured and stored in above grade storage tanks located north of the new terminal.

Sewerage. The Lessee shall pay to the Port Authority such of the existing and future charges for sewerage services furnished by New York City as are presently or may hereafter be imposed or assessed against the Port Authority in respect of the Premises or its use and occupancy thereof. In the event that New York City or the State of New York is now furnishing services with or without charge therefor, which are beneficial to the Lessee in its use of the Premises, and shall hereafter impose charges or increase existing charges for such services, the Lessee agrees to pay to the Port Authority such of the charges or the increase in charges as may be imposed or assessed against the Port Authority in respect of the Premises or its use and occupancy thereof.

The purchaser shall be obliged to install an on site sewerage treatment plant at his own cost in accordance with the sewerage guidelines and requirements attached marked C. 15 INDEMNITY The Purchaser acknowledges that it is aware that it is the Seller’s aim to achieve a high standard of development within the Moditlo Estate. The Purchaser acknowledges that the Seller has established a Moditlo Body corporate whose members will be all the owners/registered owners of property in the estate as well as the remainder of the property, and accordingly, the provisions of the Memorandum and Articles of Association and the rules of the Moditlo Body Corporate shall pertain to the Property and the purchasers thereof. 16 CONDITIONS IMPOSED BY THE SELLER AND OR THE TRIBUNAL IN TERMS OF THE DEVELOPMENT FACILITATION ACT The portion shall be subject to the following restrictive conditions, which the purchaser acknowledges shall be enforceable by the seller and which conditions shall be incorporated insofar as possible in the title deed of the portion -
16.1 the purchaser shall not be entitled to erect a dwelling house or building on the portion without the prior written approval of the Moditlo Body Corporate;
16.2 the portion may not be fenced;
16.3 the purchaser shall not be entitled to sink any boreholes on the portion; and
16.4 the purchaser may not subdivide the portion.
Sewerage. Maynooth forms part of the Lower Liffey Valley Regional Sewerage Scheme which also serves the towns of Leixlip, Celbridge, and Kilcock and soon will serve Straffan. The sewage treatment plant at Leixlip is currently being upgraded and there are proposals for further upgrading. However, the capacity of the plant is finite and must be managed between all towns within the catchment area. While the capacity is considered adequate to serve the needs of Maynooth over the period of the plan, development must have regard to, and may be constrained by, the overall capacity of the Leixlip works. For large development proposals, developers are advised to consult with the Sanitary Services Department of Kildare County Council at an early stage. The Council recognises that surface water drainage in Maynooth is inadequate and the present practice of disposing of surface water through the combined sewerage network is unsatisfactory. The Council intends to establish separate foul and surface water sewerage networks for the town of Maynooth. The Council also intends to culvert the stream through the Meadowbrook estate. The Council may require on site attenuation of surface water if, in the opinion of the County Engineer, a development is likely to cause flooding or potentially destructive storm water surges. No planning permissions will be granted on newly zoned land that might, in the opinion of the County Manager, significantly increase the risk of surface water flooding. In particular no planning permissions will be granted on lands zoned ‘New Residential’ within the catchment area of the Meadowbrook stream pending the completion of the flood relief works on the Meadowbrook and Lyreen rivers recommended in the hydrological report commissioned by the Council from Hydro Environmental Ltd., to the satisfaction of the County Manager.
