For completion of a service, we allow a maximum of 500 miles or 4 weeks’ leeway on either side of the stipulated time (whichever occurs first).

Servicing requirements. If required by Plan, Agent must inform or distribute any Plan communications or materials to Plan’s customers in a timely manner. Agent will perform all reasonable duties and services required by Plan to service Plan’s customers. If requested by Plan, this may include delivery and explanation of administrative forms (initial and renewal). Agents must provide to Plan current and accurate employee demographic data, coverage history, and other information requested by Plan regarding a group or prospective group. Any material misrepresentation of any information given to Plan is considered to be fraud, and will result in forfeiture of any payments due under this Agreement, and termination of all obligations to Agent by Plan.
Servicing requirements. (a) The Handbook requires the servicer of a Guaranteed Mortgage to prepare an annual risk assessment using Xxxxxxx Mac Form 453. Freddie Mac has discontinued use of Form 453 in the servicing of its conventional mortgage portfolio, and now requires use of Freddie Mac Form 506 instead. With respect to any Guaranteed Mortgaged owned by Freddie Mac, the Secretary will accept Form 506 in lieu of Form 453. The Subservicer of each Guaranteed Mortgage will prepare the annual risk assessments.

Section 7.01 of the Standard Terms is replaced in its entirety by the following provisions: Upon the occurrence of any event for which a Servicer may be terminated pursuant to its Servicing Agreement, the Master Servicer shall promptly deliver to the Certificate Insurer, with copies to Saxon, the Master Servicer and the Trustee, a certification by an Officer that an event has occurred that may justify termination of such Servicing Agreement, describing the circumstances surrounding such event. The Certificate Insurer or, if a Certificate Insurer Default exists, the Master Servicer may terminate such Servicing Agreement at any time if (i) the Servicer Termination Test is not satisfied or (ii) in the case of Meritech, Dominion Capital, Inc., ceases to own, directly or indirectly through one or more subsidiaries, 51% of the issued and outstanding common stock of Meritech or Saxon Mortgage or (iii) any other event for which a Servicer may be terminated by the Master Servicer pursuant to the Servicing Agreement shall have occurred and, in the reasonable judgment of the Certificate Insurer (unless a Certificate Insurer Default exists, in which case in the reasonable judgment of the Master Servicer), such default is material and not technical in nature. Unless a Certificate Insurer Default exists, the Master Servicer may not terminate a Servicing Agreement without the prior written consent of the Certificate Insurer. If a Servicing Agreement is terminated, the Master Servicer shall enter into a substitute Servicing Agreement with another mortgage loan servicing company acceptable to the Master Servicer, the Certificate Insurer and each Rating Agency under which such mortgage loan servicing company shall assume, satisfy, perform and carry out all liabilities, duties, responsibilities and obligations that are to be, or otherwise were to have been, satisfied, performed and carried out by the terminated Servicer under such terminated Servicing Agreement. Notwithstanding the foregoing, no such substitute Servicing Agreement need contain a covenant by the substitute Servicer to purchase Converted Mortgage Loans. Until such time as the Master Servicer enters into a substitute servicing agreement with respect to the Mortgage Loans, the Master Servicer shall assume, satisfy, perform and carry out all obligations which otherwise were to have been satisfied, performed and carried out by the terminated Servicer under the terminated Servicing Agreement. Servicing to be performed by the Lender on Agency guaranteed/insured loans must be at least equal in quality to that servicing provided by a prudent institutional lender for its own portfolio of similar loans which are not guaranteed/insured by the Government.
