8 1. SHERIFF shall render law enforcement services during the 20221 Orange 9 County Fair, beginning at 0800 hours on July 12, 20221, and terminating at 10 1600 hours on August 176, 20221. Such services shall include the 11 enforcement of State statutes and, in SHERIFF’s sole discretion, the 12 enforcement of the City of Costa Mesa Municipal Code.
13 2. SHERIFF shall be responsible for and render to DISTRICT law enforcement 14 services at all areas of the Orange County Fairgrounds during the dates and 15 hours referenced herein.
16 3. SHERIFF shall provide all staffing, supervision, communications, supplies 17 and equipment necessary to deliver services, as required by this agreement. 18 If unforeseen events occur requiring more or different personnel or 19 equipment to enforce State statutes and the City of Costa Mesa Municipal 20 Code at the event, SHERIFF, in SHERIFF’s sole discretion, may increase or 21 decrease the number and type of personnel and equipment utilized at said 22 event.
23 a. “Unforeseen events” will be defined as the following: Emergency 24 incidents requiring a response by law enforcement personnel to mitigate 25 the incident at any area of the FAIRGROUNDS, including parking lots, 26 the Grandstand Arena and the Pacific Amphitheater (hereinafter 27 “FAIRGROUNDS property”). DISTRICT will be responsible for the cost 1 of said personnel from the SHERIFF only. Any other agency’s personnel 2 will be considered mutual aid. If the incident does not start on

Such services shall include the 11 enforcement of STATE statutes and, in SHERIFF’s sole discretion, the 12 enforcement of the City of Costa Mesa Municipal Code.
13 2. SHERIFF shall be responsible for and render to STATE law enforcement 14 services at all areas of the Orange County Fairgrounds during the dates and 15 hours referenced herein.
16 3. SHERIFF shall provide all staffing, supervision, communications, supplies 17 and equipment necessary to deliver services, as required by planned 18 staffing assignment levels previously agreed upon by STATE and SHERIFF.
19 4. By mutual agreement in writing between the STATE, through the Fair 20 Director or designee, and the COUNTY, through SHERIFF, planned staffing 21 assignment levels may be increased or decreased, depending on the need.

SERVICES BY COUNTY. 11 1. AGENCY occasionally has a need for law enforcement patrol services to 12 supplement those provided by AGENCY. As requested by AGENCY from 13 time to time, at the discretion of SHERIFF, COUNTY shall render to 14 AGENCY selected services as hereinafter provided to the extent said 15 services can reasonably be performed. SHERIFF will provide enhanced 16 patrol, security, or other law enforcement services using specialized 17 resources, including, but not limited to, the Mounted Enforcement Unit on 18 property owned by the AGENCY and as identified as “Patrolled as 19 Requested” in Attachment A, which is incorporated herein by this reference 20 and which may be amended from time to time. In the event the AGENCY 21 requests an amendment to the list of areas to be “Patrolled as Requested”, 22 AGENCY’s CHIEF EXECUTIVE OFFICER, hereinafter referred to as 23 “EXECUTIVE OFFICER”, or designee, on behalf of AGENCY and 24 SHERIFF, or her designee, on behalf of COUNTY, are authorized to 25 execute amendments to add new locations to Attachment A, as long as said 26 amendments to Attachment A do not materially change any other provision 27 of this Agreement. 28 // Attachment B - Redline Version of Previous Agreement Page 4 of 9

SERVICES BY COUNTY. County will provide CCTA the following services, as directed by CCTA, to acquire property interests required for the Project: appraisal and appraisal review; negotiations, land rights document preparation; right of way acquisition; right of way project management; title and escrow support; right of way certification and/or supervision of independent contractors providing such services, all as more particularly described in the “I-680 Express Lanes Project Scope of Services” attached hereto and incorporated herein by reference (all of which constitute “Services”). The County warrants that it will perform these Services in accordance with accepted professional standards and procedures.
SERVICES BY COUNTY. The COUNTY will provide dispatch and communications services for TRIBE as described below. The cost of services is outlined in Exhibit "DA-2", except as those costs outlined below under paragraph V B.
A. COUNTY will provide all dispatch services for fire and rescue resources for emergency and routine operations for TRIBE. This includes activities within the TRIBE’s primary jurisdiction as well as external or mutual aid responses. TRIBE agrees to pay for these dispatch services at the rates shown in Exhibit “DA-2” based on the total number of emergency responses within the TRIBE’s primary jurisdiction made by TRIBE fire resources for the preceding calendar year.
B. TRIBE is responsible for the initial equipment and start-up costs per the county standard issuance; if applicable. COUNTY may provide radio communications equipment for the type and number of radios shown in Exhibit "DA-2 (cont.,)" with the costs and expenses of such equipment being reimbursed to COUNTY based on the actual costs as a direct Invoice to the TRIBE. Additional technology devices may also be provided during the term of this Agreement, reimbursed to COUNTY by TRIBE, based on the actual costs to the COUNTY at the time of purchase. All technology devices used will meet Riverside County Fire Department communication equipment specifications.
▇. ▇▇▇▇▇ OF LICENSE MDC For and in consideration of the commitments of COUNTY and subject to the fulfillment by TRIBE of all of its obligations set forth in this Agreement, COUNTY hereby grants to TRIBE a non-exclusive, non-transferable, license to use the software installed on each Mobile Data Computer (MDC). TRIBE may not sell, lease, license or otherwise transfer any rights therein, nor use or exploit, for any other use or purpose except as expressly set forth above. COUNTY shall maintain sole and complete control of all licensing agreements and software installed on each MDC.
